We need some help. My husband and I currently owe 5 payday loans, we have had them for quite some time but each payday we must reborrow in order to pay our bills. We owe 3 for 400.00, one for 600.00, and one for 150.00. This past payday we couldn't pay all of them so we paid 3 off, reborrowed and well, the other two are about to come after us. We live in Ohio, and these were from stor front lenders. It should also be noted that we only had to give 2 of them checks as collateral. I don't know what to do, my husbands work slows down this time of year and his checks won't be enough to cover things soon. I got a job but I am not making enough to help out much, We have 3 children also. I am considering a chapter 13. Will that even help? I am at my wits end here, Please help!


Are all of these store front loans? I'm really surprised that they allowed you to borrow without a pre-dated check??? That's highly unusual! Please list the names of the lenders, you can do a search to find out whether any of these lenders are members of the CFSA (The Community Financial Services Association of America ), CLICK HERE for the website. Most likely these lenders are members which would entitle you to requesting the EPP (Extended payment plan), this enables you to pay off these loans in four payments on each payday, but you must request the EPP at least one day prior to their due dates.

Yes three of them are no checking sccount required loans, So what means do they have in coming after us? The names of the loan places are, Checksmart, Loansmart, Ace cash advance,Payday loan, and the other one was from a check cashing place, I am not sure of the name of that one. So I can request a paymenat plan? What about the two i defaulted on already?

The two you defaulted on don't qualify for the EPP, sorry, you have to request the EPP before you default. They will sue you in court if you don't contact them and ask for some type of payment arrangements, if I were you, I would send them a letter and a payment (via money order), no matter how small the payment at least it will show that you aren't trying to get out of your responsibility, and it will look better on you IF they do pursue court. Just explain your unfortunate situation and continue to send in payments (money orders only!) on each payday. I'm not sure they will work out anything with you per telephone or in person, but at least if you send them a letter (make sure you send it certified return receipt and keep a copy of the letter for your records!), it will show you are making an attempt! :)

Are payday loans able to be included in a chapter 13 bankruptcy? I know there is a iffy line because you can't inlude debts that are within the last 30 days and payday loans get renewed every two weeks (well ours did anyway) But we have had these loans for quite some time it isn't like we went out and borrowed a bunch of money and now we just want to get out of it.
