I need help fast. I just received a call from Nash from an affadavit company in SanDeigo Ca. He wouldn't tell me the name of his company. He said that an affadavit would be downloaded tomorrow at noon with charges against me from 1st US Bank (he would not tell me the name of the payday loan). He said he was calling to get my attorneys information (which I don't have one) and said I would be arrested at my job tomorrow. I am scared out of my mind!!!
I have had several payday loans (all of which were not legal in the state of Florida) I followed everyone's advice on this web site and I have dealt with a few, some just will not give me a mailing address. I called an attorney and I will go and see him in the morning. Has anyone had this experience? Has anyone dealt with this Nash (I think that was his name, he has a very thick accent). Someone please talk to me!


What I don't understand is this guy said that the payday loan doesn't want money they just want to make an example out of me. He never asked for money and he wouldn't give me the name of the payday loan so I could call. He said they do not want any communication from me.
The lawyer I called said he couldn't stop charges but if I get arrested to call him.

He also said that they are charging me with 3 charges
1. Federal Bank Internet Fraud
2. Check fraud
3. Violation of Banking Laws - EFT's denied
He said a Federal Crime Investigator will be at my job tomorrow to arrest me and my bail is $5484.87
I can't have them arrest me

As Shazzers said, they are not going to arrest you. They are just trying to scare you. If anyone was going to really arrest you, why would they warn you about it ahead of time? Generally, people are not notified that they are going to be arrested. And the reason they say they will arrest you at your job is because they know that will scare you the most. Relax and breathe!

Hi I am still here! I haven't heard from the guy today. But I did file a complaint with the Florida Attorney Generals office, the FTC and the Office of Financial Regulations. I did forget the BBB but I will get them tomorrow. I did go see an attorney this morning (45 minute free consultation) and he told me all the same things you guys told me (thank god he was free). I never doubted anyone but I had to be sure before I went to work. If I were to be arrested at work I would be fired immediately! I work at a big hospital, and that just can't happen there. Thank you all for being there during my freak out!!! I owe you a lot...your emails were the only way I got any sleep last night. I know it isn't over by a long shot but that was the first time I had ever received a call like that. I will keep making my payments to the pdl's that have given me address'. Someday it may be over!!!

thank you all so much. I figured out it was paydaymax because he said the affadavit was from 1st US Bank and paydaymax was the only one that said that bank name on its original paperwork, and when I went back and looked through my emails something he said was in one of the emails. So I think it is a pretty good guess that it is them.
