A Writ of garnishment was issued on my bank account. The bank took all that was in there ~300.00. The total amount due is ~$2800. Will more money be garnished if I make a deposit? The bank said no.


When they get a bank levy, it's only good for money in the account at the time it was executed. They take whatever funds are in the account, up to the amount of the order. After that, the order becomes discharged.

That doesn't mean they can't ever take from your bank account again-- it just means they have to keep going back to court and get separate attachment orders each time they want to levy your account.

Keep in mind, every time they go back to court for a new withholding order, probably $85-150 is being tacked on to your balance in court costs alone. If you have a means to make payment arrangements without them having to garnish, you will save yourself some court costs.

My current bank account of $830.00 was recently seized. If I open a new account in a different bank, how soon can they locate that account and how does a collection agency find where you bank?

How do you know if it is a one time thing or more than once if money was taken out of your acct. I was told to contact the Sheriff's office for more information. I was supposed to go to small claims for a car that I paid for over 5 times because of refinancing at higher interest rate due to loss of job - then they repossessed. Sold for less than what the refinanced loan was - Imagine that? I called the Rent a lawyer the day before court and he said he would take care and get back to me with a settlement - Now my bank account is empty!

I'm going to guess that you live in Texas, The Carolinas, or Pennsylvania? Either that or you're currently not working?

It would be in your best interest to call the creditor that is seizing your account. You can make some type of arrangements with them...It should be easy to do, they would rather not have to keep filing the paperwork to seize the money! Please do this..Or they will keep getting attatchments.. And like Debtcruncher said, you will have a whole lot of extra fees added.

Can a creditor seize the assets in an account if 2 names are on the account, such as husband and wife, and only the husband owes the debt?

a writ of garnishment was recently sent to my bank and my acounts frozen. A total of $172 was taken. Should I file to dissolve this writ? should I file an exemption if needed or just forget it and work out with the creditor another repayment plan??? IS there a neeed to hire an attorney for this issue at all??
