I would file a complaint with the CFSA outlining this lenders refusal to honor the EPP plan, at the same time I would send a copy of the complaint to the lender who refused to honor it!
What can I do if I????????m dissatisfied with the service I receive from a payday advance company?
If the lender is a CFSA member, it will have the CFSA Member seal affixed to its window. If you have a problem with the lender that is not resolved to your satisfaction and/or you feel that the company has violated a CFSA Best Practices, you may file a written complaint by writing CFSA at the following address:
Community Financial Services Association of America
515 King Street
Suite 300
Alexandria, VA 22314
or send an email to cfsa@multistate.com.
about the EPP refusal
I came at Saturday (and I am due on Monday)
The girl who was in the store told me that she cannot do it and I will have to comeback on Monday to talk to Manager. I let her know that I have to come one day before the due date to activate it.
The girl called somebody - seems like a manager - and after finished talking to him - told me that they are not part of the organization that allows extended plan (This guys have CFSA sign on their doors - but I did not see any CFSA rules or regulations shown on walls or tables - they are nowhere to be found) Somehow I was able to make this girl to sign paper that said 'I cannot set you up to Payment Plan and you will need to comeback on Monday' - then when she start thinking and did not want to give me this paper - but I got it by the end of the story)
Now I am going to comeback there on Monday, if they say 'NO' they probably will try to run my check - I probably need to put a block on my account to stop them. And it seems like it will be some nice fight ahead.
Thanks to you, guys, I think I am ready - I will let you know how it goes. If you have some nice advices on a way - let me know.
Store is in Madison, Wi, PaydayUSA.

If they have a sign on the door (or anywhere in their store) which says "CFSA", then they need to take it down if they are not going to honor it. I would still fill out a complaint with the CFSA, I would also make it clear this lender has a sign up which states they are members, I would send them an email and state what you stated above, along with the information they have a sign posted which states they're members of the CFSA. That is misleading, and I am willing to bet if you go back to the store and take a snapshot of that sign (use your cell phone!), and submit it with your complaint they will be obligated to offer you the EPP plan. This is the kind of crap that needs to stop, and these companies need to be held to their word! I hope you pursue this! I would definitely stop payment on that check since they refused to honor the EPP plan! You are building yourself a good case against them if they should happen to TRY to sue you.
Continuing the story with EPP refusal ( Paydayusa/Americash)
I put a 'debit only' block into my account. I called in the morning to the phone that was show as the 'Have any Questions or Comments?' sign - person who answered told me he is the the Owner-President of the company (not sure if it is true) I asked him if the company is member of CFSA - he was not too eager to answer me - and kept trying to find out why I am asking. I explained to him - he said the they used to be and not anymore. I let him know that signs on the doors of the store says otherwise. He did not seem too helpful and recommended to speak to store manager.
I came back to the store - manager repeated that they are not part of the CFSA - not anymore. I repeated that they should've take the sign off the door in this case and now I request EPP because they have this sign. She offered me to pay down my loan - I refused and requested EPP again on same terms that CFSA offers it (4 payments, interest freezes) - she offered me to pay 1/2 of the debt right away and than whe would put me on payment plan - I refused and repeated about 4 payment(1/4 each) and that they need to be attached to PAYDAY (Fridays in my case) - she offered me to pay 1/4 right away and we would start the plan - I refused and said that I can comeback on my PAYDAY - she said - 'see you in Friday then'. I got a feeling that she knows that I have ways to proove that I am right. I will be watching my account closely just in case and will go back on Friday. I also requested Complain forms from CFSA and they also provided Central phone numbers for this company (they have 2 names Paydayusa / Americash)
Good luck to everybody. And thank you again for your help.

naniko2003 I'm proud of you for taking a stand, so many times people are intimidated because they aren't aware of their rights. You just keep pressing them, and as I said before, I would take a big fat picture of that sign and email it to the CFSA, I would also write an article to the editor of your local newspaper about their (the pdl company) bad business practices. By them having a sign up saying they are members of the CFSA, then stating to you they aren't - is misleading and dishonest!
Continuing the story...
I went on Friday to the store. Only thing that manager asked me - was 'If I want to pay off the loan completely today' - I said 'NO' but I can split my debth on 4 payments and can pay first quater today. Without other discussions - manager wrote and agreement - took 1/4 of money from me, gave me copy of agreement and we said goodbuy to each other.
So, this one worked out out well.
Unfortunately I have more loans to take care. I will tell later how it is going with the rest of them - with loans where companies were not part of CFSA and I have to go into default to do something about with my payments.

You live in Wisconsin right ? If so you should look into a CH 128. Wisconsin has a very unique law that lets people in debt obtain the same kind of legal protections against harassing creditors and their collections agencies that filing for bankruptcy provides. At the same time, this law lets someone pay off all their trouble debts with one, easy monthly payment. This law is not new, but it is not well known, even by most attorneys in Wisconsin.
If you are a Wisconsin resident, have any steady source of income (even disability benefits), and need fast, effective debt relief, Chap. 128 of the Wisconsin statutes can provide an easy court-ordered plan to force most creditors to accept repayment of most debts (even student loans* but does not alleviate interest & penalties on most student-loan defaults, taxes and child-support arrears.) in comfortable, monthly increments over a period of three or fewer years.
Like bankruptcy, this stops credit-card and most other kinds of interest, and it stops creditors from harassing you. And like debt consolidation, you get to pick and choose which of your bills you want to pay in full at a rate you can handle (retaining more of your good credit history)!
Typical debts that can be handled through a Ch. 128 include:
???? overdue utilities
???? accounts in collections
???? PayDay loans
???? credit cards
???? medical bills
???? personal loans
???? Wisconsin taxes*
???? child-support arrears*
???? vehicle-loan deficiencies
???? civil judgments
???? tickets/fines
???? practically anything other than car or home loans!

I would suggest looking into Chapter 128. This is what I am doing and everything can be done online.
About 128 chapter and credit history
Do you know how bad is 128 for your credit history?
Even when I took those loans - I had a lot of credit cards to pay but was paying them accurately - I actually have decent credit history now. How much will I damage it if I will use 128 chapter?
It shouldn't really damage it at all . It doesn't reflect on th
It shouldn't really damage it at all . It doesn't reflect on the credit report that you are in a CH 128 . Plus typically pay day loan lenders don`t report to credit bureaus. Besides even it it did hurt you credit its the least of your worries. You have a debt problem not a credit problem. You can always start reestablish you credit after you are out of debt. You are getting killed by the ridiculous interest rates and you must stop the cycle.
Continuing the story...
I am paying to this story (PaydayUSA) - they signed some papers with me about the payment plan and I am also receiving some mail from them ('You did not came in the due date, there is still time...') - I am not sure what the mail is about - I will ask them about it this friday - when I will be making my next payment.
I talked to some other stores (who are not members of CFSA). I really do not want to do chapter 128, but I am ready if I have to.
Actually it also helped during the negotiation with this stores. I just let them know that I wish to have a payment plan and if they cannot do it I will have to use chapter 128 and spread my payments for 3 years. They seem cooperative so far.
I have one more store do make an agreement to about the payment plan - I will go there today. But so far - most of the stores agreed to some kind of a payment arrangement without the % growing. Which is great - it helps so much.
I may be soon out of this trouble - doing good so far.
Good luck, guys. Hang on there - we can do it.
