I am being sued

I just looked on Case Net and found I am being sued for a Tribute Master Card I had. I have tried and tried to work with the law firm who is collecting it but the guy has been very difficult. They have only had the case since May and the guy has been very snotty each time I talk with him. I am scared to death I will be served at work. I am going into the hospital for surgery tomorrow. Is there a way for them to mail me the summons? Help!!


what state are you in?who is this collector?we can help you see
this more clearly.please answer the two questions.

It was just turned over to the lawfirm (basically a collection firm) in May. We made arrangements of $50 per month but I was only able to make payments in July and September. I even talked to the office on Monday to set up a recurring payment for the 15th of each month. Come to find out, the lawsuit was filed on October 2 which is before I talked to the guy on te 6th. He is very nasty. When I pointed out I had tried to work with him around the surgeries I have had to have the past few months, he said I was good about keeping in touch but only made 2 payments in 4 months so he recommended th lawsuit. I am in Missouri. Collection law firm is Kramer & Frank. The credit card is probably 4-5 years old.

i was sued by them back in june or july. i'm in missouri also. They went to court and couldn't validate my debt so they had the case cont.. and them I got a letter from the judge saying it was dismissed without prejudice.

I never called the lawyer office. My lawyer went to court for me so I don't know what all went on in court.

Hopefully they don't come back I think they can only refile within a year. I think

J9284, you should have already sent them a DV letter. Depending on what state you live in, the SOL could have already expired, but when you sent them a payment, you restarted the SOL. Since you haven't sent a DV letter, be sure that you attend the court hearing, then ask for validation during discovery. If they can't produce validation, the case will be dismissed.
