The true status of my account is Webpayday.com deposited $525. To date I have made payments totaling $468.25. Which leaves a balance of $56.75.They are harrassing me at work via phone. It is my direct line so not tooo bad, but they have not honored my cease and desist letters, sent five times. What should I say in response to the email above? This is their first attempt to contact me via email, they have just been calling and calling. What is my next recourse? I live in NY and I sent Webpayday all the information that PDLs are prohibited and I also secured my accounts.[/quote]

They're illegal, so basically they aren't about to honor your cease & desist letter. When they call, simply hang up, speaking with them only gives them a reason to continue calling back, there isn't much they can say to thin air. You need to forward that email to your Attorney General's office, explain in detail what has occured. I would also file complaints with the FTC & BBB, you may as well, you have nothing to lose by trying. I hope your bank account is closed? Just respond in simple words, you need a physical address to send your last payment of 56 bucks, via money order, tell them, no address, no payment. That's about all I would say, bombard THEM with that email, daily, over and over again.

Actually, go to your Attorney General's website, there's usually a link somewhere to fill out complaints, usually they ask for identifying information first, your name, address, phone, the lenders name, address, phone, etc. Explain in your words what happened, then copy and paste the email you received into your complaint.

i think webpayday is legal i found this on utahs website. but i think that since payday loans are illegal in new york that it makes your loan illegal

No, if you signed a contract that you agreed to let the laws of the state they are licensed in apply to you, then you are bound by that contract no matter where you live. It's called "choice of law" and all state laws recognize it in contracts. Probably ought to read those documents before you take out a loan - or better yet just plan to pay it back and you won't have a problem!!

Actually, if your contract says you agree to be bound by the state they are licensed in (Utah, Ohio, whatever), then you are bound no matter what state you live in. It's called "choice of law" and all the states recognize it in contracts. Better read the documents before you sign - or better yet, pay your loan back!!
