yay, I won against Weltman, Weinberg and Reis!!!

So I was sued a couple months ago by WW&R and I didn't go to court so they won by default judgment. I was going to let it go but then they attached to my bank account and put a hold on it for $4000 and then I got another notice to come to court and testify about my assets. So, I went to court and disputed that I owed the money. While the judge was not pleased that I didn't come to court the first time, he granted me a new hearing for today for motion to set aside judgment and also the lien on my bank account expired today. So, I went to court with my attorney and the plaintiff's attorney was there. They asked me questions, yada, yada, yada like why did I make payments on the account if I'm disputing it, etc.... Long story short, the judge granted my request to set aside judgement. YAY!!!!!!! So, I ran as fast as I could to the bank as fast as I could and withdrew my money!!! No money for you Weltman, Weinberg and Reis you BA$TARD$!!!


You really didn't win, you just got the default judgment vacated. The lawsuit that was filed against you still continues. Taking money out of your bank account won't make your creditor go away, as there are other ways to collect on a judgment (when and if your creditor does get a judgment).

sorry, just getting back to the discussion. No, it was not dismissed, just set aside. I see it as a small victory for me and for the little man. Yes, the case is still open and they can come back to try to garnish wages or other such action but we'll see. They haven't ever responded to anything else I've sent or even my lawyer sent on my behalf, asking for discovery, validation, etc.... I'll hang low again and see what happens. Sorry if I misled anyone into thinking the case was over and I won the case. I do feel like I won the hearing, whether that "counts" or not.

i have been sued by those pp four times, won one time by default the others i make a monthly paymnet, but the problem they do not report as in repayments. are they truly represnt capital one? or all to faul the court. please any one know.

Call Capital one and ask what your balance is and make sure you have all your receipts with you and I hope they were sent by money order and certified and then you check to make sure they did recieve them and next you check with the MoneyGram to make sure they cashed it, I do this each and every time. If you find that Capitol One has not gotten them, they have misrepresented and is liable for a law suit, they have done this many times and they have also prined out a form from the internet to have your bank account garnished only in my case, I acted very fast have filed within the 5 days and the Judge told them to give my money back, there was not one signature from the Judge nor the clerk of courts and non of any of their attorneys and my bank had no right to release it without a judges signiture and I reemed them a new butt. The attorney present wanted a continuence and the judge just said this paper is not legal and give her her money back, you had no right and I will not delay this case in any way shape or form.

Let WWR make fools of themselves, they have no regard for proper filings and will bring a fake witness to testify against you. They will never answer you certified letters or give you requested legal documents. THEY ARE FRAUD, AND SHOULD BE STRIPPED OF THEIR LAW LICENSES AND THROWN IN JAIL.

[FONT="Book Antiqua"]WWR always supplies the debtor with a copy of the legal documents. You receive a copy of the complaint when you are served by the Sheriff. You receive a copy of the default judgment when the court mails it to you. While I know it may be hard to pay your bills in these economic times, I must tell you that you CANNOT ignore the calls from WWR. They give you ample opportunity to pay off your debt before it moves to legal action. If you don't think WWR is real, just check the better business bureau.[/FONT]

WWR lied to me, i have a case with Capital One and i contacted them to make payment arangements and told them I didnt want to go to court.They claimed to agree to my terms,and then sent me a "consent to judgement" form with the amount and agreeing to 11% interest, I wasnt about to sign that at all.I was served about a week later with a summons,and I filed a Answer to the summons.Ill go to court and let the judge figure it out.
