I have just gotten a divorce and per our post-nuptial agreement my ex is responsible for an account that equals about $6000. It is now about 6 months over due and he has yet to pay on it. I have just been informed from the collection company it will be going into charge off status if the amount is not paid in full. I do not have the money and it will take some time to take him to court. If I bring the account current, which is $1200 and make plans to make payments, is the collection company still able to have it charged off?


I was advised by my divorce lawyer that if my ex does not pay what her deal is, my credit score will be effected and there will be collection agency contact. However, I was advised not to pay; instead supply a letter of explanation to the 3 major credit monitoring companies so it is included in your file. I hope there are better, and more effective advises going to be presented here. Good luck.
