Check Resolution Services threatening to serve summons–I’m too scared

I called this number back and lo and behold the same guy "Kevin the process server" answered and his name is now Seth. I know it's the same guy, because he has a very distinct voice. He kept putting me on hold saying he needed to talk with the bank about arrangements. When I asked the bank name he said it was First Federal. When I took out the loan with Check n go, the bank was First Bank of Delaware....not sure about than one.
He said the bank would give me 90 days to take care of this matter and he needed my debit card number. I told him that I would not give him a debit card/nor ACH information, but if he would give me an address I would send him a money order and make arrangements that way. He was like "Oh no, by the time we get your money order, you will have been served and then there's nothing I can do." He told me about all these fees I would incur at court and then they would fly their attorney in on his corporate jet and I would have to pay for that also! Good grief!
I told him to do what he needed to do because I wasn't giving my bank information. He kept saying he couldn't believe I'd rather go to court than give out my bank information! He said "Well, I see you really want to pay this off, so let me contact the bank again and see if they'll wait and I will call you back."
He called me on my cell phone, home phone and then when I didn't answer I get a call from my area code and when my son picked up the phone it was him with a totally different name on the caller ID. I know this was a ploy to get us to answer the phone by using a local. Not sure how he pulled that one off.
Anyway, I would be willing to make arrangements to get this debt taken care of, but all these underhanded tactics are ridiculous. I have a hard time believing that after almost 2 years they are now saying they are going to take me to court.
Anyone have any knowledge of Check Resolution Services or collection agencies with Check N Go, or just give me some advice on what to do.

I have every number from bill collectors and the number from them never popped up. well anyways they wanted me to pay the full amount which I can't pay right now due to money troubles well they didn't like that answer and said they are going to sue me for defraudation (which Ive never heard)....then when I asked for the full name of the company and the law firm they were with they hung up on me. I called back several times and was hung up on. After several times of calling and arguing with the woman she told me that she would call the cops and have me arrested for harrassement. I told her it was required by law that they give the name and address of their company if someone asked. Then they called my work today and was rude to the front desk lady. Ive never talked to someone so rude and told them as soon as my lawyer finds the name of the company. Anyone else worked with this company or heard it?

whoever called playing process server broke the law,and yes the humanoid does work for CRS.you see process servers don't call ahead,and don't do collections.also they would just serve you.do not pay them and file a police report for the harrassment as that is what this is.then file AG,FTC,and BBB complaints.then meet with that lawyer and plan to sue CRS yourself.

He also stated that if I wanted to try and make some arrangemnts with the company to avoid legal trouble I could by calling 877-255-2156. So I called. The automated voice says its the number of Law Office of Anthony H. Rodriques and givees me a promp menu to choose from. After speaking waiting for a rep they tell me a summons was issued for me to appear in court for a pdl from check n go, but I could settle with them since I haven't recieved the paperwork..... yea right! I cursed them out like it was no tomorrow. How dare you try to insult my intellegence. The next day while awaiting for the "process server" I recieved a fax from this company at my job stating that it was a VOM letter (Verification of emoplyement), once again this companyh got a tongue lashing as I called and let them have it. THe gentleman who talked to me stated they now owned the debit and I can settle out of court with him before my case was fowarded to my corresponding county in Alabama. I laughed at him and told him just like that you guys can take back legal documents and summons? I told him since you taking me to Monopoly court, I'll pay you with Monopoly money...... The only way they getting my money is if they get it like the IRS and that's take it!!!

I do not remember the name of the company however they called regarding an old internet loan from 2008. I do not have caller id so i do not no what number they called from. they threatened me with a summons and said they will be here tomorrow between 10 and 12...tell me these are the same people

I am so glad you posted this... just a few days ago I got pretty much the identical call... from a man stating he would be by my place of residence today to serve me papers, ending the call with "You have been notified"... The caller ID said "Private" but when I called the number he left it also connected me with an Anthony Rodrigues. I immediately told the person I spoke with I wanted proof of paperwork, and he told me they couldn't give it to me because it had gone to the company who would be serving me.
I did call my county courthouse just to make sure nothing had been filed against me, and they said there was nothing at all.
I'm still a little worried though... this guy called my cell and business phone both today and said he was on his way out to my house today. Should I be concerned?

When my mom asked what it was in refernce to they told her they needed a contact number for me. My mom insisted that they give her their number and she would pass it on to me. They hung up on her. They left a message on his machine saying I need to call this number 877-348-3599 and that a lawsuit has been filed against me. I called the number and a gentlemen called me this am. His first question was did you get notification from a server? I told him I received serveral calls from soneone looking for me. Do you have any idea what this about? I told him no. He said it's in refernce to a payday loan that was from 2008. That I owed them money from the loan due to insufficent funds from my checking account. When I told him my account was closed due to the fact that they took money out of my account more than twice a day and it caused overdfraft fees almost near $1000. I also told him that as of Feb of this year this matter was paid off through a real collection agency in the amount of $750. He told me that the amount was for $500. I told him that because it went into collections that other charges were applied. He stated that I must have taken out a second loan with the company and that was what he was collecting on. I told him there was only one and I paid it off. I had the letter of payment in front of me. He then told me the letter was not valid due to the fact that I didn't have an original account number. I told him the letter was valid, it was on the collection agents letterhead with all the information "I" need to state it has been paid. He spoke in circles and said I will get back to you, because I need to reasearch this matter further. I'm still waiting for a call.

I delete the msgs because I know it is crap, all my PDLs are paid off. Just now I get another call at my office from some other dude who says he is taking over for Mr. Jones, and that he will be coming by my place of employment today "as his schedule works" to serve me the legal paperwork. I told him, "Great, look forward to seeing you! I am here until 5 PM." I wanted to ask him what kind of car he drove and tell him I'd be waiting out front. They used some number I have not seen before and hwen I googled it nothing came up except some kind of Canadian insurance sales or something. It was like 877-383-2183 or something similar.
Yeah, total effin scam. Last time I checked, process servers never, ever, EVER call you beforehand to warn you that they are coming. Their entire goal is to surprise you and catch you off guard. This is nothing but a stupid scam.

Bottom line is, they legitimately buy your debts from lenders such as ACE, CashNet, etc. They reserve the right to take you to court for not paying because they OWN your debt. They may have the wrong tactics and they do break the law every single call, but they aren't lying when it comes down to the facts. If you people want to stop receiving calls, pay your debt, make sure your payment doesn't bounce, and get on with your life. I bet if you put as much time into taking care of your finances as you do trying to avoid them, you would live a much happier life.

This is a scam that is usually targeted to consumers that have taken out Payday Loans. I was hit once last year and once this year by two different organizations. I contacted the Federal Trade Commission who handles consumer complaints and they confirmed that this is an organized attempt at consumer fraud. Anyone can become a collection agency and buy a list of names and numbers of people that have had debt problems in the past. I encourage everyone to read the Fair Debt Collection Practices Act online to learn your rights.
Most important note that,
1. A creditor must provide you with a letter of allegations in writing. Nothing is verbal.
2. The consumer has 30 days to dispute the claim in writing.
3. It is illegal for a creditor to threaten you with a lawsuit, jail time, arrest or similar action.
4. You can only be contacted once per day during reasonable hours that are specified in the law.
Don't let them intimidate you with fear. A reputable collection agency will always offer payment arrangements as a first attempt to collect past due money. They would rather get some of it back than none at all. Going to court is expensive and is considered a last resort.
Most important, never give out personal information over the phone to anyone that you don't know. This includes bank account numbers, address, place of employment, names of relatives or friends. They use this information to make it appear that they are a legitimate business.
Think about this, if someone bought a list of 1000 names for $500 and was able to convince only 10 people to send them $1000 each, they would be sitting pretty with ten thousand dollars. And all they had to do was make a few phone calls. Don't give them your hard earned money.
I filed a formal complaint online with the State Attorney General's office and the Federal Trade Commission and they have used this information to build a database to close down these groups and take leagal action against them. The only way these Government agencies can help is if you fill out the form and file a complaint.
I hope you find this information useful. Next time I get one of these calls I'm not going to loose any sleep over it.

Too many debtors use it as a convenient way to buy time, delay paying anything or just as something to hide behind. If you guys truly want the calls to stop here is some simple advice.
-Ask for a settlement (a high % of your balance will be interest)
-If you decide to pay it off at one time you will probably get the best settlement.
-Get something in writing (email or fax works) so that arrangement you have made with said company.
-Know company and collectors name and how to contact them.
-Finally make sure you get a paid in full letter
Lastly, stop using the law to justify not paying your debts. Ever wonder why collectors are forced to use such methods?? Just be happy you live in a time when you wont have to go into indentured servitude or be locked up in the tower of London for owing money.

That might be good advice if the original loan was issued legally in the first place, however, we are discussing online payday lenders in this forum for the most part, and a high percentage of them are Internet criminals who issue loans without obtaining the proper licensing that would give them the right to collect interest and fees.

I got a call from CRS saying I had fraudulant check charges pending for an outstanding PDL. I called them back and asked for the balance, and they said with penalties and interest that I owe $1725.00. It has been so long since I had taken out this PDL that I had forgotten about it, however it is true that I owe to Advance America. But I knew there was no way that I owed anywhere NEAR that amount of money. The man that I spoke to was not rude or mean, but very pushy. He did say that the bank was going to file a lawsuit if I didn't pay or make arrangements. He offered a settlement of $515.00. I asked him what the original debt was, and he was unable to provide me the information. He asked me to make an offer, so I did and he said it was "accepted" if I could make a partial payment immediately, and the balance in full in two weeks. I (stupidly) gave him my information. The first installment came out of my account, and I received an email detailing the arrangement. I was unsettled about this, so I looked the company up online, and I found this blog. I called Advance America and they said that they did indeed sell my account to a collection agency called Precision Recovery. I was informed that the balance owed was $217.25. I will stop payment immediately on the next installment. I tried to call them to tell them that I would only pay what I owe, but they are apparently closed on Saturday. I will make new arrangements to pay just that.

My husband got a phone call from a Ms. Davis that they are trying to locate him to be served a summons regarding a fraudulent debt and that if he didn't show up for court that he would go to jail. We knew he had a Pay Day Loan with Check n Go and caution went out the window with the threat of jail so we gave them our debit card number to make a $100 payment with the remaining balance of $515 to be paid within two weeks. The original loan was for $200 *blank stare* the bells and whistles still didn't go off at this point. At any rate we are in the midst of disputing the $100 payment with NetSpend a debit card we purchased to make the payment (thank God we didn't give them our banking info). The number Ms. Davis called from was 877-420-9911.

The answer is because they can not. Collection agencys exist because they are funded by banks who consumers like yourself have stiffed on the money you owe them. No one forced anyone to ever borrow money from them. It was a choice that you made and also the choice not to pay back the money like you had originally aggreed to. If you want to see collection agencys disapper pay your bills on time and then there will be no need for them. Dont hate people because of mistakes you have made.

I told him I was going to call him back in 2 hrs to provide him with my info. So glad I looked into it. So what do I tell him besides the dummping letter?

There is a post on here talking about "it's your own fault if you don't pay back your debts....." No one on here that actually owes a debt is actively trying to NOT pay. At least for the most part. What we are complaining about is the tactics. The law is the law, and if they were truly legit they would follow them to the letter. With that said, I too have recently run into these people called "National check resolution". They called my fiance' and scared her into giving a pre-paid debit card (my advice) with the same tactics of "your're about to be served unless you call..."
Well, I asked them what the call was about this woman tells me it is for a check written to check n go, written in 2006. First of all, we have never taken a PDL from them, ever. (however, she has had some issues with identity theft, and our experience with this is sobering to say the least but that another story) Second, they promised to send written proof of the check, specifically i asked for a copy of the check. She agreed to everything while asking for the account info. If it had been me they were after, I would have blown them off, asked them to verify my address and tell them to come on by and i will have the police there to legitimize their server and have him arrested for violating KY law.
But, i was denied my chance to play, my Fiance' was freaking out, so i gave them a a pre-paid debt card that still to this day has a zero balance. And repeated the conditions of agreeing to pay. Nothing ever came in the mail. I have emailed them several times with no reply. last friday (over two weeks later) i got a letter with payment terms listed but no information about check.I took the time to look into the matter further.
First they cannot serve you in this manner, and no process server would call you anyway.
Second, a legit debt collector would not divulge any information regarding YOUR debt to anyone else in their attempt to contact you. It is against a host of privacy laws.
Third, its civil, not criminal.
SO, with that info, I have checked the laws concerning recording laws here in KY, and have decided to forward her calls to my google voice account and then have google voice forward the calls to her cell phone. For those who don't know, google voice allows you to record your conversations, just press 4 when after you answer the phone. The recorded message will be stored on your account. Downloadable to boot. ;) I think i will let them spew their BS for awhile and then inform them they are being recorded and then ask them questions aimed at the BS they just said. Should be interesting, and i will then send this to the AG and whoever else needs to be contacted. Today the first payment was to be made and they called her however she didnt answer. I am going to get this set up asap and see how their tune changes. I'll let you know how it goes. Seems I get to play a little after all. :)

This is in response to submission 233 and 234......Let me get this straight...So your saying that when anyone calls and says "you owe this, pay me now or your going to jail and the summons is on the way as we speak if you pay now i will have it cancelled, you have to make an arrangement now, this phone call, or your going in front of a judge and go to jail, the server is on the road now, ...."
you should just get out your wallet and start tossing dollar bills their way?.... really? without demanding proof? And when they say they don't have it, or you don't have time for mailed proof, that's ok? Oh, and they don't have to provide address or any kind of traceable information. Never mind if you happen to be the ones who never took out a PDL in the first place. A lack of proof is laughable.

No you cannot call me back, you must make payment arrangements now. No I cannot take mailed payments (that requires me to give you a physical address) only credit card or ACH
Tomorrow, i will call for another company and my name will be Thomas. I will demand some more money. Just giving you a courtesy call in advance, so you can get your finance's together. I will already have your account info so you won't need to provide that. :o
Dont ask for proof, i don't have time nor the inclination to provide it. after all, "Too many debtors use it as a convenient way to buy time, delay paying anything or just as something to hide behind." Those are your words.
It's not buying time, its validating the debt. Why should I pay just based on the word of someone that dodges all attempts to get proof of debt? And only responds with scare tactics to boot!!
