Payday lenders filing an internet fraud against me

I have several cash advance loans outstanding, two of which have been willing to work with me, however payday advance plus will not, they want the full amount and claim they wont accept anything else, today they called me at my job which i have asked several times not to call me here and he said if you dont call me back immediatly we will go ahead and charge you with internet fraud. What is this and can they do this?

Welcome to the forums.

Do not get scared of these legal charges that they claim can be put on you. Though, they have the right to ask payment from you, but they can't intimidate you.

Do send them a letter with the payment plan that you can afford each month. Along with it send some money in advance. This will put more weight to your letter. They might be unwilling to accept the plan at the very first instance, but they will somehow accept it later.

Keep negotiating with them and don't get tensed with what they say. They won't take any actions against you as long as you are willing to pay the debt. The words that they use are some of the common practices in illegal collections. But you should tackle such problems confidently.

Kim, they are full of it. If anything, they are comitting internet fraud (whatever that is). Send them a partial cease communications letter stating that you'll only deal with them in writing.

Generally, a debtor consumer has no right to a "payment plan" regarding a consumer debt if there is an "acceleration clause" making the debt immediately due.

A DC may not contact a consumer at work if the consumer has stated either 1) his or her employer does not allow such calls, of 2) it is inconvenient for the consumer to take calls at work. To do otherwiwse violates the fdcpa.

Accusing someone of commiting a crime, e.g., "internet fraud" in connection with the collection of a consumer debt with no basis for doing so is a serious and major violation of the FDCPA. Consult with counsel right away!

With only a very few exceptions, the fdcpa does not apply to original creditors (or succeeding creditors who took nondefault debt).

There is no federal law that governs OC conduct like the FDCPA governs DC conduct. Some states have mini or similar FDCPA statutes which do apply to the OC. PA is one of them.

If a PDL is relending money from a different institution does that not make them a third party? I found that warning to the PDLs on the FDIC website that they may be subject to the fdcpa because of there reloaning practices. Also Bud Hibbs has told me that they are subject to the law for some other reason that I am unclear about.

BEWARE This is dangerous! Allow access only if you have a good reason too (and preferably a good firewall to boot). In most cases it's better to just run multiple copies of Proxomitron on each PC.
If you do, you may want to disable URL commands so remote users can't cause trouble. Keep in mind URL commands you can load files remotely or change the current config - make sure they're only available to PCs you control. At the very least be sure to create a custom Prefix to use before all URL commands. This can act as a simple password since no URL command will work unless it's preceded with the prefix you choose.

Department of financial Crimes of the US Federal Division, yeah right. There is no federal agency by that name, but they did successfully break federal law by trying to impersonate a federal agent. Why not file a report with your state attorney general's office. I'm sure they will love to hear about that.

...perhaps debt-collectors have their own special organization that further chastises and berates debtors - which the call something like that...

I DID find ONE real organization who's name contains the words "internet fraud"...(or at least did until about five years ago...)

"The Internet Fraud Complaint Center" (IFCC), was renamed in October 2003.

ic3 is a partnership between the FBI and the National White Collar Crime Center

I have not yet personally used this service, but it appears to me to be geared toward the collecting of complaints by CONSUMERS, (not debt collectors - lol) and the maintiantanence of a database of complaints for law enforcement use.

(I can think of a number of times that I apparently COULD have mentioned a company's behavior, or scammer activities to this agency, but I wouldn't suggest rushing into filing lots of complaints without being sure that you're RIGHT - not just torqued...The FAQ on their site says that once you file a complaint, you can not "cancel" it, you're committed to maintain your position..ADDITIONALLY, since the complaints are made available to law enforcement on all levels, they clearly state that they can not guarantee the privacy of your complaint...)

The site offers tips about internet crime schemes and prevention, both of which are good for a read through, and a mechanism for reporting internet crimes and fraud.

IF you've been had, you shouldn't let them get away with it - it only encourages them... Consider reporting scammers.
A couple of years ago, I recovered several hundred dollars from an online auction rip-off. I did all of the research to hunt the "seller" down, and dealt with his state's bureau of investigation. It took several months, and a bunch of effort, but I got full restitution and, as it turns out, the guy did a little time, because I was one of 16 defrauded at the time of my complaint! This guy "sold" stuff he never owned for his income!

(..if you collect any restitution, use it to pay some debt!)

Since the offending post was removed, (thank you cannr), all I can do here is echo other posts.

Personal attacks are not permitted on this site, and will not be tolerated. We can and will ban members & guests who do so. We are here for to help each other (and new guests/members) get out of debt and to answer their questions..and to offer a shoulder to lean on while you work through your own personal debt hell. Why do we do it? Because we've been there.
