I am sending out a 2nd validation letter to Midland as they did not properly validate. All they sent me was COPY of an old statement, nothing else.

My question is why do I need to send a copy of my first validation request letter along with the CRRR copy. Is this really necessary to send, them?


Good information to know, as I just got my first collection letter from this company. From all that I read, they are not a very reputable CA and tend to violate the fdcpa whenever they feel they can get away with it. Bud Hibbs has them listed as one of America's worst CA and advises they love to use the American Arbitration Association and to sue debtors. So I imagine I'm going to have a battle on my hands with these clowns.

I'm up to it, though.

I think it interesting to note, the first letter I received from them looks like some sort of credit card statement, complete with a detachable payment coupon so I can conveniently send them my money. It also list several different pay-plan options for me to take advantage of. It has noting on it about my right to request validation of this alleged debt within the first 30 days anywhere on it. The "this is an attempt to collect at debt. . . ." phrase is on the back of the letter, by itself, almost like they put it there as afterthought.

Is the fact they don't even put the information regarding my 30-day dispute right an FDCPA violation? Isnt' it called "overshadowing?"

Well, they now have copies of my debt validation letters on the way. I honestly cannot remember the name of the OC they have listed, and don't remember seeing it on my credit reports when I pulled them months ago.

The reason I have always sent follow up letters, is to cover my self in case I goto court. I want it in the second letter to show that I did send a DV to them in a timely manner and they received it and signed it.

I learned long ago, always cover yourself with papaerwork that can be verified. This doesn' mean that they won't take me to court, but that I do have several letters where I have contacted them and the refuse to validate, and/ or have continued to contact me,e tc..karen
