I stupidly took out a loan from Cashnet USA a few months back. We fell behind on our payments and couldn't catch up. So I've been trying to get everything together so I could send something. The original loan amount was $300. I paid them about $100 a few months back.

Lately I've been getting a call from TRI & Associates saying that they are suing me and I need to send them $555 to clear up the account. I told the lady who called here that I cannot afford that, and I'd be happy to send in $100 now and then $50 a month until it is cleared up. She said that wasn't good enough and that she would be expecting a money order for $555 in her office by Friday (10/17).

Well, I never sent it because I didn't have it. I've never even gotten a letter in the mail from these people and our first contact was a month ago. So all this week they have been calling. I have caller ID so I recognize the number.

Tonight, I was sick of the calls every 5 minutes, but I didn't feel like dealing with them. So when they just called at 8:45pm I answered the phone. They asked for me and I said "sorry she isn't here, can I take a message". The lady said "yes, this is Beth from TRI & Associates, please tell her that the judgement is going through on Friday. She can call us at 1-877-268-9286" and then hung up.

What floors me is the fact that she told someone she didn't think was me, that I have a judgement going through on friday!

What if it had been my babysitter or a relative? I'm super mad. Plus, they never sent me a letter about collecting the debt within 10 days after contact. The just call and threaten.

Is there anything legally that can be done. I mean, I'm aware that she was talking to me, but she didn't know it was me, and she didn't even bother verify if she "thought" it was me. She just blabbed about a judgement. Isn't that a privacy issue?


I would dig a little deeper into this before following the Guest aboves advice. They are only parrotting partial info and from what I can see have not a clue and shouldn't be giving anyone advice.

They had 5 days form initial contact to send you a dunning letter. If you are in a 1 party state I would immediately start recording. What state do you live in? They are required to send you a summons to court if they intend on suing. The fact that she is claiming "that the judgement is going through on Friday" is a threat and may be actionable. Get it on tape and seal the deal. IS Cashnet an Internet PDL? You borrowed $300 and have paid $100?

check your bank statements.what shows up on your debits.PAYDAY LOAN YES or CASHNET500 has been claimning to be CASHNET USA.if CASHNET PEFFLS or JUST CASHNET is on there then this is an illegal pdl.CASHNET USA is legal and wouldn't call to threaten. they would just file suit.please check your bank records that would tell who you are dealing with.

my reference recieved a call from a agency stating that they going too summons her and me for a loan with cashnet but hse had nothing to do with the loan she was just a reference what do I need to do here in TX to fight this

again.this is probably CASHNET500 aka PAYDAYLOAN YES.cashnet usa is legal and won't hire an illegal bunch of clowns to threaten.they can and will sue you.they won't risk any trouble by acting illegaly.unlike paydayloan yes aka cashnet500.

I had gotten calls now from two different places claiming they are trying to collect a debt from Cash Net USA the first company that called was a foreign man who had made threats to me and even to my children and that he would be showing up the next day with a police officer to arrest me and put me in jail till my debt is paid off! I recorded the call and all the threats from this man and then went up to the police station by my home and let the police officer listen to the recording! The officer then called the man up and the man hung up on the police officer 6 times! The police officer asked him what he was talking about and the man said it was a legal matter and could not say such and then the police officer said well if you are threatening to arrest this young lady we would have to know about it and we have nothing and told that man he needs to stop calling me! Well this was in November of 2008 now April 2009 I am getting calls from Tri-financial and Associates and they are threatening me to file a suite against me for the debt with Cash Net USA and have my accounts taken away for 7 years and that I could settle with paying them 150.00 a month and I can't afford that I'm a mother of two and not working right now! I was going to make a payment then my legal council informed me not to make any payments until they send something in writing with all of their info and their EIN # Tax Id # and the girl got mad and said well if you don't send in a payment we will not send you anything! I have been informed not to make any payments over the phone or by credit card cause unless it's in writing it's not worth paying you need to know what and who you are paying and they refuse to give me that info!! So if anyone else could help me figure out what to do next that would be great and or if anyone knows the Tax ID number or EIN number for TRI-FINANCIAL AND ASSOCIATES that would be great!!!

ANY collection agency is required by Federal law to send you, in the mail, what is called a dunning letter. If they don't send you a letter in the mail, do not speak with them. File a complaint with the Federal Trade Commission and the Federal Communications Commission and your state Attorney General's office.

AND, since you have that recording, sue them. Ask the policeman to appear as a witness for you. You can collect $1000 for flagrant FDCPA violations plus possible attorney costs and court fees.

How much did you originally borrow? How much did you pay them back? If you didn't complete the payments, how much did you pay them? What state are you in?

I too had a telephone call from, and conversation with,Tri-Financial on behalf of CashNet. The call was over 2 weeks ago and I have not received any written notification from then other than a fax sent to my place of employment, without my permission, about settlement of the account. I have filed complaints against them with the FTC and my AG's office. I just got the name of an attorney in my area who handles debtor's rights. I was surprised they so blatantly made a third-party disclosure of a debt.

Dear sir or madam, believe me when I tell you. TriFi & Associates, Vision Credit Services, Brewers, Michaels and Kane, Carousel & Associates and many others buy tons of cashnet payday loans for .10-.20 cents on the dollar. The add on top of Cashnets interest and penalty $200 in interest which they can according to the contract andthen add more and tell you they are going to sue you if you don't pay. My advice would be to tell them while your recording the conversation,........................ most payday loans are illegal in the states anyway,........... advise them they are not calling on behalf of cashnet, they bought the account and own the contract. Advise them that you will settle for 40% or nothing. They will not sue you. Reason for this is.......it would cost five times the amount to sue you, you get a small claims judgement, and never pay. The would loose on thousands. Trust me I know this all for a fact. This company breaks the law at every turn. FTC and FDCPA. Do Not Pay this Company unless they are will to settle at 40% the original debt!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Also, if they threaten you with court, then by law they have to send the court info. Which means that an Affidavit and Assignment has to go to your circuit court and then the judge will issue an execution to be delivered to you. This is a 30 day to 3 month process depending on the judge and attorneys. Was your Mini Miranda read to you? Did they advise you they may have been recording for compliance? How do you know he or she wasn't using an alias? Is Trifi or any of thier affiliates or associates even licensed to collect in any of the states? NO they are not! You have a lawyer call them and ask for the dismissal of the loan and paperwork to prove that it was dismissed. The can't even report a payday loan to the credit bureau!!!!!! Trust me I know for Fact!

I received a call from this company TriFianacial trying to collect on a payday loan that I could not pay at the time in 2008. The loan wasn't for more than $300 and they want me to send $730 like tomorrow. That's not going to happen. They said they would settle for $400 but the want that within 2 weeks or I could pay $600 if I have to extend to the next month. Payday loans are like a nightmare you can't wake up from. Other than a BK what else can I do the put a stay in this process?

I took out a Cashnet loan, could not pay back, and now getting 17 or more phone calls a day from International Asset Group, LLC / IAG. I finely set their number as rejected on my cell. Now I am getting a letter stating I am over 90 days past due. and the following actions may be taken. 1. A summons will be filed according to your States Bad Check Laws, 2. The cost of Collection Agency Commission Fee (22% of the amount due) will be added to your account, 3. The debt information my be listed on your comsumer credit report and or Chex Systems, 4
Civil Judgement may be executed against your wages, real prperty or other personal assets. They give me a number to call and for me to ask to speak with soneone in the outsourced legal department. Now my question is can my bank account be frozen or my wages be garnished? Will they be able to do anything as far as my house? I live in TX if this helps anyone in letting me know what I can do. The collection agency is out of NY. I have not talked to them so do I need to call?

Oh I just went and checked and International Asset Group does not hold a bond as required by Texas law. You can send them a letter stating that as they hold no Texas bond they must immediately cease all collection activities that include filing suit or reporting to your credit report. If they continue to attempt to collect illegally you will take them to court.

Can they touch my payroll? If I offered them a payoff of the amount I barrowed do you think they will take it and leave me alone? IAG(International Asset Group ) is very unprofessional when you call them they ask for you to refer to investigate collins. they called my job and threaten to take me to jail and sue me for fraud. i have filed a complaint with the attorney general office & have filed a complaint with the ftc. they even told me to stop calling but saying that i owe them and wont prove it and send me a letter to validate the debt. they are crazy.

I never took out a cashnet loan i applied for one but the only card i had was a prepaid debt card and they told me that i needed a bank debt card. my bank statments does not say they sent me the money. yet they claim they sent me 269.00 in march what do i do they are calling and wont stop. they say they are going to take me court and sue me. help

Hi...I just received a call from Wallace and Berg Attorneys at Law who said they are suing me for fraud on a Cashnet Loan. I used my husbands social security number (he knew about it), but they are saying they will sue me for fraud now. This is from a loan from 3 1/2 to 4 years ago. I never had the money to repay them. He scared me enough that I gave him my banking account number as he said I would go to jail since this was not just an unpaid debt, but fraud. Is this true? Can he due this. I am now divorced and a single mom. I live in PA. I don't know if this is from Cashnet500 or CashnetUSA. I don't remember and all he said was Cashnet. Can anyone help?

Just wanted to say thanks for your input. Very interesting news. I was going through the same thing and was wondering if I should pay these people. I took out a loan from them and paid them back. I have a confirmation number and everything. The loan was $300 and they're saying that I owe them $2,800 plus!!!! I am not paying. It was a loan from CashNet USA.

Did you ever get an answer on this. I did the same thing with my husband and he knew about it. Mine was about 4 years ago and I haven't heard anything from them. I'm not even thinking about it, but found your input interesting since it was exactly what I did. I think you're fine though. They will waste tons of money trying to take you to court. They have to SHOW UP in court (which will cost them money) and they are not that stupid!!
