Bank Garnishment
Date: Thu, 10/23/2008 - 12:02
I posted this in the debt consolidation forum, but I should've posted it here:
I've seen posts related to my issue. However, I'm still in need of help. My bank account is frozen. The court date isn't until Nov 5th. In the meantime, I have no funds. They froze it due to a credit card in my husband's name and we have a joint checking account. My questions are: 1 What are the chances of the judge taking everything in the account for this $18k that my husband owes. 2a what exactly is the wildcard exemption for IL? 2b Can I make the $3500 in the bank totally exempt based on that? 3 Can I go to court earlier to try to have the funds released? 4 Should I hire an atty (I can't really afford one)? 5 I'm still waiting on the garnishment notice. Does it have to be mailed within 2 days or received by me within 2 days. I keep saying "I" or "me" but it should be "we" or "us" considering it is my husband's issue. Any advice would be greatly appreciated.

I believe that if the account was frozen with a court order, there isn't a way to gain access to it without the same.
That's really the only thing I can add here
