Granny, how were they able to garnish your checking account? Did they have a court hearing? You need to speak with your bank manager and tell them the withdrawals were unauthorized and to refund your money; you need to remind the manager that your social security is exempt from garnishment, you then need to close that account and open a new one. My attorney suggedted that I have my social security sent to my PO box to keep this from happening.

What state do you live in? Your SS income will be exempt in any state but you must provide that information to Mann Bracken. And, as Guest asked, where you sued or been given notice of Arbitration and either not respond or had no knowledge of it? The bank may not be able to do anything if they have a court ordered levy against your account.

My court date is Nov.19 for this
I had to get a legal aid attorney they called the bank they won't budge, she called the creditor they won't budge when I tried to talk to them they hung up on me and I was nice and calm to them. The thing is the bank has returned 2 of my bills I paid and charged me $35.00 for return fees I have no money resources at all.I have filed excemption claim with the court. Social security office its to late to change the direct deposit for Nov.so the 3rd the SS money won't be available to me.
Back in 2003 when I was no longer able to work I requested from this loan co. to file a disability claim on the insurance with this loan they redid the paper work and left it off and then said I didn't have this insurance but I look at the original loans papers and it did.I could'nt pay I did get a paper about going to court but I was told I didn't have to go back then. Now this

Granny, I am so sorry to hear about your struggles. One question to ask your Legal Aid Attorney...since your SSI is exempt, will you be able to recover from Mann Bracken what they garnished?
Social security monies are federally protected, and not subject
Social security monies are federally protected, and not subject to garnishment/execution.
Tell your legal aid attorney to get off their #$@ and do their job. You can sue your bank and mann bracken if the refuse to put back your social security money.

I have a similar situation except I have given Mann Bracken over 2700.00 for debt that does not even appear (not in the last 3 years) on my credit report. I told them I wanted validation of the money owed and they still have not sent me anything. Now I hear they are gone. I have copies of the checks they cashed; but where did my money go. I have tried to contact the original debtor but they have no records of my debt. Mann Bracken started legal proceedings against me and when I was in the hospital in November I missed a payment on the payment plan and even though I had my mother call and tell them why, they started up the lawsuit again just because of one missed payment after receiving over 2000.00 from me in 2009. How do I find out where my 2700.00 is?
