SOL?
I have a old Nextel acct from 2001-2003 in collections with afni. I live in Florida.
What is the SOL on this?
Long story short, my phone was stolen in 12/03, I called and "froze" my acct. because I did not have insurance on the phone and no spare cash to buy a new one.
they didn't freeze the acct. calls were made around the clock to Peru for 4 days and I get a bill for $1600. I fought with Nextel who offered me a $926 settlement. I said no and contacted BBB who did nothing. Then collections started which I have never paid, till this day.
Does the SOL begin from the date of the original charge? when I cancelled my acct? How long? 4,5,7 years? Should I pay it and get rid of it?
How does payment of settlement vs in full affect my credit?
Any help is greatly appreciated. This is a black mark on my credit history that I need to take care of, as I am looking to buy a home after the new year.
Thank You.

I believe the SOL begins ticking starting with the date of first delinquency or the date the first major deliquency is reported. You'll find those listed on your credit report. If however you make a payment after that date, the SOL clock starts over again. A company can report that the payment received was not in full but in the amount offered in the settlement. At this point though...I wouldn't worry about how it's going to affect the credit report - the damage is already done since it's now in collections.
Did you try disputing these charges? If they truly aren't yours, then you shouldn't be responsible to pay them. I would talk to Nextel and try to do whatever I could to get this straightened out and get cleared from this mess.

I would send a C&D to the CA telling them to pound sand....the debt is out of SOL. It will drop off your CR in a couple of years.

I tried tirelesssly to dispute the charges. Nextel corporate sucks. people wouldn't give me names or id number and would hang up on me.
There issue was that they claimed I never called to say that the phone was lost/stolen and to put the acct on hold.
I disputed that I spoke to someoen for 30 min trying to get me an "affordable" replacement option, that I couldn't swing at the time, hence the reason to "freeze" the acct.
They said this call never took place. I had called BellSouth to get my phone records, but was told that they do not itemize unlimited local calling, so I was screwed. No proof.

the original statement date was 1-27-04, DOFD 2-27-04, however I paid my monthly new charges (to keep service) until March while I disputed the intl charges. Then cahnged cell companies.
anyone know the actual SOL on this cell account? 4,5,7 years?
