Hello everyone-

I hate to be doing this post, I really do.

I had some debt that I had been paying off a while back, but in January of this year my wife and I were jobless. She is still without employment, but I now have a job and are just barely getting back on our feet. It has been extremely tough and have had more than our share of bad things happen. We were hoping to have made this year a good one, but it just hasn't happened that way. And now it appears to be getting worse.

Because we had absolutely no money, I couldn't pay Bank of America for several months. Yesterday I got a letter from Harrison Ross Byck saying that their office has been retained to collect a debt. It doesn't say anything about a court date, nothing about being sued, just says that it's a demand for payment because "I have had ample time to pay the creditor."

On it is also something that mentions CACH, LLC. I have not received a single piece of correspondence from CACH, this is first I've heard from anyone aside from Bank of America.

I really really just want to negotiate this down to something that I can afford and make it go away. I had been doing just fine until my wife and I lost our jobs and were getting killed bill-wise. What can I do? It says if I don't notify this office in writing within 30 days they will assume the debt is valid, that's all. I wanted to work with a debt negotiation and in fact had called one to set something up, but they don't even talk to creditors until I have a huge sum of money in the account and obviously I'm not going to have time to do that now.

All of this is making me incredibly depressed. And scared. I've read some of the horrible things that CACH has done to other people, and I just can't have that happen to my wife and I. I can't go to court, I can't get sued, I can't lose everything I've worked so hard to put together in this life. Please help... I can't even eat or sleep anymore.


First off.....welcome....and don't panic or sink down into the depths of depression. I, along with many others here, have been there and done that. Debt is a reality most of us have to face and at times it can be overwhelming. Just don't panic and take a deep breath.

CACH is a junk debt buyer so it sounds like BofA may be out of the picture. Have you pulled your credit reports recently? If not, go to www.annualcreditreport.com and pull your free annual reports from all 3 credit bureaus. What state do you live in? When was the lst time you made a payment on this account? We'll get you thru this so just relax and calm down. OK?

I had been on a debt management program, and had been doing well. Until my wife and I lost our jobs, that is. Now the kind of money that I had been paying seems ludicrous.

I live in California, which makes this situation even harder for me personally. This debt was mine from before we were married, but since this is a stupid communal property state, this is now her problem too. It's totally unfair to her; she has enough hardship in her life right now.

I'll go and get my credit reports. What do I do after that?
