I live in ohio...good idea to check credit report. i checked it within the past year for being denied for credit so I should still be entitled to a free one. I just thought it was strange that HSBC sent me to an attorney's office if I just talked with them this week and set up a pymt arrangement for 10/31. The attorney also thought it was strange and wants me to fax him something in writing from HSBC about the pymt.

OH has a 6 year SOL on open ended accounts and 15 years on written accounts. Everything I have seen on cases regarding OH residents has been 15 years which puts you well w/in SOL. If HSBC still owns the account I would do my best to work directly with them. You might have to climb the ladder beyond the phone jockys that initially answer the phone. Keep digging until you get to someone that can help you.

I have dealt with Forster and Garbus. Get everything in writing from them. They are real low life's and they lie about a lot of things. I had a bill that I had paid and then they wanted another $350 for lawyer fees. I asked what lawyer fee and they started telling me about a summons and all. None of which I had received and none of which made any sense. I asked the lady about the summons because I had never received and that it is now a year later so I would have assumed that had there really been a summons there would have already been a default judgment. The woman then tried to tell me that with the summons I would set the court date so nothing had happened since I hadn't set the date. When I told her that I know that's not how it works that I would only have 20 or 30 days to answer a summons and then they could get a default judgment she just stopped talking and said she didn't want to fight and I was being rude. One of their letters to me has said that they were sending a judgment to the court which also blew me away -- how do they send a judgment. I've checked with the court and they have no record of summons or judgment from them against me. But be very careful with them because if I go on line and see what cases they have coming up in my county there are hundreds of them.

These guys are definitely low lives. I had quite a surprise when I went to the bank to withdraw money from my savings account, only to learn it has been frozen and that I would have to call them. Nice Christmas Present from these waste of human flesh. I have an appointment Monday afternoon with my attorney. It's pay back time for these scumbags!

bill collector....not that your response even deserves a reply...i don't believe that taking money out of someone's account without authorizaton is the same as making "acceptable arrangements". the problem with most debt collectors is that they are unwilling to work with the consumer...if you insist on using the aggressive approach and "stepping up your game" then go for it... I personally choose to send my money to the less aggressive bill collectors ...you know what they say "you catch more flies with honey" BTW, just because we owe on our bills doesn't make us "losers"...I'll bet you a dime to a dollar I have a better job than you do , higher salary and benefits.....and I can sleep nights knowing I don't have to make a living threatening people all day. I just went into my account to check my balance as I have to transfer $$ to my son to pay college expenses. I have only a few dollars left. The scum took $3400 from my account. I also have realestate taxes due soon and have been squirling away $$ to pay for that, now I'm left without even enough money to pay for gas and groceries. I don't even know how they got this figure. About 10yrs ago I had a dispute with Sears over a $500 balance, which I disputed, they "sold" it to LV...I disputed it with the credit bureaus, guess that didn't help. What can I do? I work hard to support my son and husband who can't work due to any injury. I own no credit cards and pay my bills....

it is illegal for any debt collector to levy your bank account without a court order. The first place you need to go is to the court clerk's office in your county. You are looking to see if any lawsuit has been filed against you, and if so, you want to obtain the full docket on the case. If they sued you without serving you a summons, then this is not legal and you can fight it. If they did this without even taking you to court in the first place, then I would definitely take them to town over it.
First, if they have sued you. If you were never served, you need to check with the court clerk's office about filing an order to show cause/motion to set aside judgment due to improper service. The clerk's office cannot give you legal advice but they should be able to tell you what forms or format you will need for this. Once that is done, the court will consider your motion, and if they find in your favor on the motion then they will order the CA to replace the money they took from your account. Check also the rules of civil procedure for your state, as those laws govern proper service of a summons.
If there was no lawsuit against you at all in your county, then you should immediately contact the bank and request documentation of the lawsuit--a creditor must provide the bank with such paperwork when they levy an account, and as far as I recall the bank must provide it to you upon request. If you find that they filed a lawsuit against you in a different county from where you live, then you can file an order to show cause/motion to set aside judgment in THAT county due to improper venue. Federal law requires that any lawsuit brought against you concerning debt collection must be done either in your county of residence or where the debt first originated. If they filed suit somewhere else, then they tried to get around that law. Once again, in that case, when you file the order to show cause, if the court finds in favor of your motion they should order the other party to return the money they took.

FYI my friend, as a collector you are subject to the FDCP, in case you are not familiar with it, it is the Fair Debt Collection Practices Act, I suggest you look it up. Per this law, you are unable to speak in a derogatory manner to persons who may have the unfortunate task of having to speak with you. Lowlife is a derogatory term. Judging by your grammar and punctuation, I find it difficult to believe that you possess any education above that of a High School level.
Now, I know many people that thought they were above seeing themselves in this type of situation, people who make six figures a year (and I know that you are making roughly around 23k with a very pathetic commission structure), just as you seem to think you are. With the economy the way it is, many people are falling on hard times, and who the hell do you think YOU are to pass judgment on anyone?

I figure I will duke it out with them in court so I guess they're becoming very frustrated because they cannot get in touch with me so they sent me a letter saying that they're sending a judgement to the court - what the hell are they talking about, i answered the summons on time. Does anyone know. I see that there is someone by the name of guest that this happened to as well... any guidance, please - thank you.

This is why it is never a good idea to give these people your checking account because for instance with law firms like Forster and Garbus, they're evil... i've heard so many stories that what they do is start off initially with a payment plan and then later inform you that you need to pay the entire amount.. they then send you a summons and now your sol is active because the SOL start whenever you make a payment. I don't trust them so be careful everyone... all it takes is them saying that they sent you a summons and didn't, you don't go to court and you have a default judgment... now they have checking account info. There are many ways you can handle them that i'm learning slowly but surely. My sister is an attorney but we do not live in the same state so she has been very informative.

my sister has no idea what they're talking about either about sending a judgment to court... does anyone know about how do they do things over there? My guess is that they're just low-lives trying to scare me into a settlement, but i do not know for sure.

OMG same thing happened to me...it took over two weeks for me to get things straightened out. Thank goodness there wasn't too much $$ in my account at the time, because they took a decent chunk of it. My bank was so nice and helpful about things; the low lives weren't.
