NES is at it AGAIN, I think I'm going to jump off a bridge!!

Ugh, I can't stand this crap anymore. I've had NES hounding me for my husbands $9,000 credit card debt that charged off. They wanted $2,500 this month!! I told them there is no way I could do that. Besides, they wanted their money before my 30 days to dispute the account was even up.

So, today I drive down to Baltimore to borrow money from my mom just to get them off my back. Mr. McElrath calls while I'm driving and I told him that I was driving and I'd call him back. He proceeds to call my cell phone 13 times and my house phone 11 times and only leaves 4 messages out of the whole time.

The last two messages say "This is my last contact, you obviously aren't taking me seriously. You need to call me back with your attorney's information because obviously we need to go to the next step with this."

Right now I'm in debt settlement. Should I call them and get them to deal with it, or just ignore the guy and wait for them to get my debt settlement paperwork?

They aren't suing, I know that, because NES didn't buy the loan, they are just a 3rd party collector.


Dont give them a dime and find yourself an attorney ASAP!! They have so many violations they should end up paying you.

First of all, you need send them a C&D letter..CMRRR. You may outline all their fdcpa violations.
Second, get a copy of your cell phone bill showing where you talked to him and the subsequent calls. Photography them too. Same with your home phone. Keep a copy of your messages.

Then find yourself a NACA attorney... http://www.naca.net/
This will not cost you a dime to consult with one. It sounds like you have a strong case especially with records. Legal fees will be paid by the CA when the settle, which they will.
Make sure you tell the attorney about how much stress this is causing you.....

Thank you SoapLady. The only problem with the phone records is that they show up from an unknown number, but I know its him, because he's the only collector with my cell number. This guy screams into the phone, freaking out. And my 30 days to dispute aren't even up until the 9th of november! Ugh, they are all scum.

He left 4 messages....that is enough proof!!! He is only permitted to leave one message per day. And the message he left is clearly a violation...he is not capable of taking this to the next level.

With an attorney and threatening court and trial, they can supena the CA's telephone records.

Trust me....log all the calls dates and times including the messages left. Consult an attorney.

Here is a list of the times he called my cell phone just today:

They are all from an unknown number, but I know its him, because anytime I pick up it's him, and I don't have any other unknown numbers calling here.

Oh, one more question. Is it that they are only allowed to leave one message per day, per account? or per phone?

He left 1 message on my cell phone, and 1 message on my home phone. Then a lady from his company left a message on my cell phone, and another guy left a message on my home phone.

Still 4 messages, but only 2 were from him.

No, just say something like "sorry, I am busy right now...I will have to call you back." Dont ask him to call you back....say you will return the call. Let him continue to call...and say the same thing every time....and log each call. Only one contact is permitted each day unless you authorize otherwize.
