Can debtor sue LVNV because they report as installment account on credit reports?


I've seen this topic on every forum I've been on. They're also reporting as a Factoring company which is not factual but is the CRA's requirement for a Debt Buyer. Google LVNV and Factoring and you'll get thousands of hits. So far as I've been able to research, no one has successfully sued them for their reporting.

Reporting a collection account as an installment loan is a tactic we see now and again. Installment accounts that are past due put a bigger bite on the ol' credit score than a collection account. It's a violaction of FCRA, and actionable to the tune of $2,500 per occurence. 3 CRAs = 3 occurences.
