My company very carefully monitors and deducts for court ordered wage assignments however we keep receiving a demand for payment from Sonic Payday and it is not a court order. There is a document with a digital signature attached from our employee We tell them we wont deduct without a court oder - what is our legal responsibility? I don't want to become a bank - its not a court order the employee should just pay his own bill correc?

DS

Welcome to the forums. The wage assignment that was presented to you is not valid. Wage assignments have to be signed in person. Also, they are not known as court orders, as a judge is not involved. There is nothing legally binding between the lendor, and borrower since it was not done in person.

If you've already declinded the acceptance of witholding funds from the employee, then you have done the right thing. I would speak with the employee, and tell them that Sonic has tried to contact you about this.

Hopefully this will make them more aware of what's going on.

Regards-
Mike
