Mann Bracken taking me to court!
Date: Tue, 11/04/2008 - 00:48
I have 2 accounts that Mann Bracken is in charge of and while using Credit Solutions they let me know that one is for about 13k and the other is for 4k. Over the phone the lady told the representative from CS that I have a warrant of debt for Nov. 19th for the 4k account.
When I called they forwarded me to a lady and I asked if I could set up payments for the account to forgo the court process as I am not in VA currently for work. She stated, "We don't do that here, you need to go to court. And if you don't go or don't have money then we'll take up to 25% of your checks through garnishing." I was flabbergasted! I told her I'm trying to give you money to take care of this, and when I stated I had some hard times she said, "Everyone has hardtimes, but you need to do what you need to do." I asked about the other account at that point to see if they would accept payments, and she stated that I was going to court for that account as well, but the thing is I've only received one warrant for 4k.. not both!
What to do? Any advice would be great!
Thanks!

check with your county clerk to make sure there is a summons for a court date.another question were you actually served a summons?they don't issue warrants for civil matters.if so show up and present your case.do not believe what the creditor or collector says about this.check your county court to see if there is a case against you before anything else.

just be there and present your side of the issue.there are certain types of income that are exempt from garnishment.it looks like they were trying to get more from you before the court date.let the judge know that too.get an affidavit from your dmp to back that up.

I'll call CS in the morning and get an affidavit. Is there anything else I should bring?
