Debt validation in court
Thanks for the info, guest! I checked it out and didn't get a verification of a license for the CA. So what does that mean? They can try to collect but not through the courts? I didn't quite understand the agency- owner- manager info either. Where does the attorney fall into all of this? He may be licensed to practice law in MI but can't represent a collection agency?

If It's the attorney contacting you, ask them for the license number for them and the debt collector. If they can't provide it them tell them to bang tar, not literally. You may want to call your secretary of state to make sure on the laws.
The problem with attorney's is a lot of them are starving so now they are getting into the debt collection business. The courts really don't pay attention to who is breaking the law, who is unlicensed or who needs to be. The courts job is to say, A owes money to B. A failed to answer interrogatories so A pays.
If you say it's yours, you lose. It is up to you to tell the courts if they need to be licensed, that you want to know if they have the right to collect from you and so on. Neither confirm nor deny the debt is yours. Put the burden of proof on them. They will not come up with it 80-90% of the time if the debt is a few years old. I am not saying to avoid bills but if you are in tough times then you need to worry about food, shelter, clothing, health, heat and running water before you pay them anything.
Hope this helps.

Well, after reading the info on the michigan website, I found out that out-of-state collection agencies do not have to be licensed to collect in Michigan if they have no clients (branch offices?) and if the money collected is not going to a michigan business, if I read it right. The web site really didn't address the requirements for attorneys who collect for them. I think I'll call tomorrow. The site gave a phone number. Thanks for your help!
