I have a younger sister that when got out of prison used my mom to obtain credit. She is now 27 and my mom is 82 ( way too big of on age diffrence) but needless to say that this girl conned my mom into signing a car note for her. Now Nissan is threating to put a lein on my moms house for the defiency balance. She lives in the state of Texas. Can they do that? If so what course of action can she take?


sounds like you are saying that your Mom co-signed for your sister for the car...If that is the case I don't think there is anything your mom can do to get out of it except to maybe sell the car and pay off the loan. she (and your sister) will be responsible for any difference if the car sells for less than the amount due on the loan...if the payments are not made on the car then eventually they will repossess it and they both will still be responsible for any amount still due if the car sells for less than owed....

Actually mom didn't realize that she was co-signing she was ill that day and was conned into signing on the bottom line. Sounds to me as if my sister has no morals at all. Needless to say that right now I am not a happy camper. I just want to see mom get out of this with no reprocussions to her house or car. Please help me to understand what I can do to help her. She is a nervous wreck & I am not sure what to do.

How long ago did this take place? They cannot take her home, so please stop worrying about that. If it has not been 4 years since the deficiency was realized then the debt is still w/in SOL but they would first have to take you to court to obtain a judgement. Even if they did obtain one, TX is about the most debtor friendly state in the country and post judgement remedies are difficult for a judgement creditor to enforce. Is Nissan the company that is threatening or is it a 3rd party collector?

I do not own a home so am not sure about this, but I am a Texas resident and am sure I read somewhere in the state laws that you can claim your home as a 'homestead' and it can't be touched....I think it means just that if it id your primary residence, they can't put a lien on it, but I am not 100% on this so you should research it. , However, Texas has some of the best laws regarding debt validation and if I were you I would use them right away...look up texas finance code, debt collections and you will see what I mean.

MOMS IN TROUBLE I BELIEVE ARE MANY LAWS IN USA TO PROTECT THE ELDERY PEOPLE WHEN YOUR MOTHER OF 82 YEARS OLD SIGNED A PAPER FOR OTHERS LIKE YOUR SISTER .
I HAVE A BAD NICE IN MY COUNTRY THAT IS LIKE YOUR SISTER.
SHE BOUGHT A CAR (ZERO )IN MY MOTHER 'S NAME AND
I TOLD HER TO GIVE BACK THE CAR.
SHE DID.
I TOLD HER WAS BETTER FOR HER TO GIVE BACK THE CAR....
SHE HATE ME.I REALLY DO NOT CARE.
MY MOTHER IS 80 YEARS OLD AND I THINK THIS IS CRIME.
