Mann Bracken Validated Debt...Now what?

Mann Bracken has now validated the debt and is calling again. Now what can I do. Is there a letter I can send stating that I cannot afford payments right now? I am currently in settlement with two cc companies and will be complete with them in June 2009 and can then start working on the next ones.


exactly shazzers.this is not a CA that plays fair or by the rules.
i ask the same question what did they send you?

The letter says:

In response to your request for validation of debt in accordance with 15 U.S.C. 1692g(a)(4), please find the enclosed validation of the above-referenced account. If you have any questions...bla...bla...bla. Signed by an arbitration manager.

The next page at the top says: Basic Account Information and lists my name, social, address, account number, date account opened, credit product type, date of charge off, total charge-off amount, amount of principal charge off, interest and due at charge off, date of last payment made to Chase, name of present creditor.

Then on the 2nd attached page it says:
Unliquidated claims for fees, costs or other anicllary relieft. Please note that, if we have not filed a claim against you and your fees and costs are $0.00, this could change at the Arbitrator's discretion. Then it lists the principal and interest again and lists 0.00 for attorney's fees, court costs, interest.

It is stamped and signed by a Notary Public from the state of Texas in Bexar County and also is signed by Juan V. Montemayor, Jr., Authorized Representative for Chase Bank USA, N.A.

nothing actually from chase?then that doesn't sound like validation to me.it sounds like numbers put together by them.i would re-send the DV letter punched up with.THIS IS NOT VALIDATION.please validate this debt.they must show an actual contract from chase and something from chase where you agree to what this CA is charging.you did not receive validation.

Ok...I will do that. In the mean time they just called and left a message at my work saying they MUST speak to me today by 3:00 p.m. Do you think they are just trying to get me to call them? In my original DV letter I also included limited C&D asking them not to call me at home or work.

the main thing is if all the facts and figures are on MANN BRACKEN'S letterhead.then i wouldn't count it as validation.i don't consider something anybody can type on there letterhead validation.if that name that notarized isn't associated with chase then they could be in big trouble.

I did a Google search for Juan V. Montemayor Jr and there were two court hearings listed with his name on a submitted document for Chase.

So what will happen if I don't call this lady back today by 3:00 p.m? Can they still call if you have sent a limited C&D to them previously? I heard Mann Bracken is quick to sue or arbitrate.

check with chase to see if this guy is employed by them.this guy could be a MANN BRACKEN employee saying he is with chase.if you call this lady back she will threaten and harrass.i still don't like this.check with chase to see if this guy is chase official.

OMG they really are such crooks! they were representing Arrow Financial for a credit card debt that was on my credit report, they even tried to take me to court. i wrote to them asking for validation and never recieved anything. i called them so much in one day that they blocked my number from calling them. i had to call from my cell phone just to get them to answer but they never were able to give me any validation. I have also talked to arrown and they dont have any validation either. dont trust mann bracken at all

My story, not legal advice, I was served a few months back and I ANSWERED and WON. Non Suit means that they do not want to proceed further and wish to drop the case. They asked for "without prejudice" which basically keeps it from reflecting negatively upon them if they ever want to sell the debt or re file. I had to "swear" all my answers becuase in Texas you must "swear" all your answers (lawyer told me it is a weird law). I first asked for them to present "VALIDATION of the debt" and I asked for a JURY TRIAL (apparantly they hate jury trials). I just reversed the heading of the document where they had me on the bottom of the heading I put them on the bottom and for all their discovery questions I stated no I did not own the account in question and did not give them any bank account information or personal information that I did not feel was relevant. Mine was a debt collection and not a JUDGEMENT (two different things). Next time I will file a counter suit (so that they cannot get it dismissed without prejudice) and I will consider a compliant with the state bar of Texas against the lawyer (he should be disbarred). If we all fight we can knock these guys out of business.

I got verification in the very same way, I knew it was bogus and next time I meet with my attorney on this matter I will definately bring it to his attention. Is Juan V. Montermayor, Jr. even exist. That's the question. Is Chase even located in Texas?

You are so right. If people would learn to stand up against these collectors and harass them as bad as they harass us, there would be less of it happening. I don't take any crap from any of them. I responded to a Mann Bracken arbitration thing about a month or so ago and they haven't responded. I hope they are giving up on it. I already told them I will file bankruptcy before they get another cent from me.

I am in the middle of a suit over Chase being handled by the "wonderful" Mann Bracken grp!!! Ugghhh! They are making demands that I can not even come CLOSE to meeting for payment of a Chase card (I had card w/ Wachovia who sold it, then was sold again by that co to Chase- so I NEVER actually signed any "contract" with Chase!) Amazing. Got to this point when they upped my interest rate to 29.99%! (And had suffered brain trauma from an fall and lost my job.) Went to court and asked 4 a continuence because I thot they wld work with me, but I am finding Mann Bracken to be quite "wiley". Glad to see that others are aware of their tactics. Wonder if they could validate my debt???

I received a letter which I was cc'd on from Mann Bracken which states that they have enclosed documents for the document hearing and the only thing they included was past billing statements. I had previously asked them to validate the debt which they have not thus far. Is the past billing statements a validation of debt?

I guess the notary is Sharon S. Galvan??? Juan if a person doesn't sign these documents, they screwed up with me and sent me a validation letter and accidently added another that was not mine, the signatures are all different, when I asked for Juan's and Sharon's contact info in my response letter Nov 2008, they went away and no contact since.

Man you all need to use the Debt settlement company that I used. They were up front on everything and they gave me the money back that they didn't use. I am now debt free and I am getting new credit card offers, just like they told me. I don't know what there number is but if you google "resolutionslifemoney" the company is called financial resolutions, good luck!
I had almost $80,000 worth of debt and thay wiped it out in less then two years.
