What if garnishment papers don't get turned in?

I'm pretty sure, by law, if the garnishment papers go to your employer, they have to abide by them. They will have to deduct a certain amount of your wages and send it to the court to pay the judgment...how much varies from state to state. In my state (MI) it's up to 50% of your gross wages after your other deductions.

It sounds like you have already received a notice from the court stating that the garnishment has been entered? (a Writ of Garnishment) Did you go back to court to dispute the garnishment, ask to have the payment amount lowered, etc? You're usually required to provide a list of all your assets, liabilities, etc.

Yes, they can have your income tax refund garnished, too.

They have no jurisdiction over your job..that's between you and your employer.

Let me ask you ,though, what was the judgment for? Debt collection? Or non-payment of rent? I'm not sure I understand.

Wow, you said in your state they can garnish up to 50% of your earnings? That seems like alot. Here in OH, I think it's 25%.

Well, maybe I had that wrong, however...it was bad. But when we went to court, the attorney was actually pretty nice and settled a lower amount owed and lowered our payments. She also withdrew the garnishment and we have been faithful about making our monthly payments directly to them. (Almost paid off..yay!) She said she didn't want to make the three hour trip every 90 days to renew the Garnishment! Lucky for us!

To Deandrea, In reference to you losing your job, I need to clarify. If you only have one garnishment against your wages, I don't think you can lose your job, however, if you have more than one, your job may be in jeopardy. Sorry for the unclear information.
