I have seen a number of posts about pdl disclosures (typically located on their websites or in their contract) stating if you agree to the terms you are agreeing to their terms regardless of what the law in your state says. Do these hold any legal water? And, if a pdl is doing business illegally in your state what is their a response you can give them when they throw that back at you? I've seen a number of posts about pdls saying that...but no response to give.


Well actually what can a person say? Is it worth arguing with an illegal/unlicensed lender, not really. Do you or anyone else really think they're going to admit their guilt, I doubt it. There is no purpose in arguing with the lenders who are lending money to people illegally, they will simply continue to respond with pre-written emails that threaten, harass and attempt to haggle with people in order to get more and more money to fill their pockets. This is just my opinion, but, I state the facts to them, then throw the ball back into their court, and usually the only response is a pre-written email with all the above. Just do the right thing and let them throw their empty threats around and ignore them. Either that or change your email address and phone number. There is no simple answer to this question, IMO.
