I sent them an email and they stated they had not logged my into the system yet. They had only logged in mail received as of 11/6/08.

I did receive a post-card from Daniel J.Stermer with a 5 digit claim number which states that my proof of claim has been timely received. Unfortunately, I can't get into the website to access the latest claims status.

I'm also caught up in this whole Hess Kennedy mess. They actually did settle two of my five accounts before they were taken over, so I'm hoping to get about $5,000 back (we'll see). What's weird is that I haven't heard from any of the companies that I still haven't settled with in several months. I recently moved and have moved three times in the past three years. Do you think they've lost me? They all had me cell phone number and used to pester me there and also would call my parents, because I was still living there when these accounts were opened. But now I've heard nothing. I want to get them settled once I hopefully get money back from this, but I'm not even sure who I would need to contact at this point to try to settle. My plan is to wait it out until somebody contacts me and then hope at that point I have the money to work something out. Any suggestions?

The reason they are not contacting you is because they are waiting until the SOL is about to run out so that they can tack on all the interests they want and at the very end they will SUE you. YOU DON'T WANT THAT. Since you moved alot they will send the notice of suing to an address they KNOW you don't live at and BAM, they get a default judgment and the next thing you know your bank account is frozen. Find out who has the accounts and work out a settlement when you get the money.
Trust me, unless you moved to another country they know where you are.

I have sent DV Letters to Weltman Weinberg and Reis over my account and I recently sent one to LVNV since they appeared on my credit report. Should I wait for them to respond to me or what should I do in your opinon. WWR Sent me a notification saying I owe about 2 months ago. I DV them and never heard back.

Well it all depends if the accounts are legit and you are willing to pay for them. If they are you have three options.
1. Don't wait for them. They have the upper hand. Contact them and work out a settlement. Ask for everything is writing on what you settled on.
2. Make them validate the debt. If some time pasts call them to see the status of validation. In this case prepare to get a lawyer. Paying $2000 for representation is a lot better than paying the debt. And if they don't really have the right to collect the lawyer might scare them off. Make sure everything you send is cerified mail.
3. Wait until they sue you. Again GET a lawyer ASAP and be ready when this comes if you feel you have the upper hand.
If it's not legit try the validation game. I did and it worked twice. If they persist you have to get a lawyer to defend you. Then sue them for breaking the law.
Now I now some are saying "But I'm still spending money if I get a lawyer" Yes you are but you are saving yourself the headaches and them just taking your money without warning. Trust me I'm going through it right now and it's a big headache trying to hide your money, pay bills, and just live without getting phone calls and a ton of letters from collectors.
A friend of mine did the DV thing and just waited for them to contact her. They never did. But this is what happened out of the blue. 1. They garnished here wages $400 a month. 2. Took $4000 from her bank account (Cleaned it out) 3. Put a lean on her house now she can't sell it. This all happened last week too.

WWR Is the one contacting me. Thanks again for all your help. I'm searching for a descent lawyer at the moment regardless of response.

Yeah they need the judgment...but if they can't find you or you never respond at all to them, that is all they need for a judgment. Once they start you can go to court to dispute but by that time you are in a world of headaches.

I just wanted to make sure that it can happen out of nowhere. One thing I have heard about WWR is that they will send your summons to an old address. They have sent me something to my current address so they can't say they dont have it. That would be shady if they did that.

If you are disputing a debt that is on your credit report, you should not only send a DV letter to the creditor, but also always file a dispute with the credit reporting agency whose report it shows up on. Info on how to dispute an entry is included in your credit report.

Tom321, as fortune would have it, I was served a summons on one of my smaller accounts 2 days later the last email. I have contacted a lawyer, and am working with providing information etc. Looks like it might be chap 13 for me, but still a better option than facing 5-6 separate suits. I will just be glad for the card that was forgiven, and move on.

I have contacted a lawyer friend who will help me out. He is going to more oversee what I do and make sure I don't mess up

So I assume at this point we wait for the Hess Kennedy receivership website to upload our individual cases so we can see our status for our particular cases with the claim number we received on the postcard that was mailed to us. I assume like myself that many are anxious for some kind of update on our claims. Is this true?

I am so tired of all this.....it get's worse everyday. I have put in around 4500 and only one card was settled with capitol one and the other has put a judgment against us for the amount owed to them. Everyone I talk to says there is nothing we can do to get the judgment off. I cannot believe that there is no one that is really protecting us from people that really make things worse for us. I mean, if we were actually trying to get help and get our debts cleared up, you would think that when a judgment is put against you that they would be willing to see that you just went through heck with a fraudulent ordeal and be more understanding. They don't care and from what I see the courts don't either. They think we should have been smart enough to figure out that Hess Kennedy was a fraud. They also think that we should know what to do if a judgment is placed against you. I had no idea what that meant and I tried to get educated on the matter but there is just way to much information that is not accurate on the web. I think someone needs to put these lawyers and county courts in their place.

I saw on reviewing the website of Daniel Stermer that Citicorp and HSBC debts were forgiven. Chase? Bank of America, Target? Could I be so fortunate?
I was contacted by another debt forgiveness/validation/consolidation firm a few weeks ago. They really sounded on the up and up and were so nice. But, I'd been burned and can't ever try that one again.
Now, without a pot to _____, I'm facing binding arbitration in the National Arbitration Forum and because the CLC has all of my money, I'm representing myself. "An attorney who represents himself...." Well, how about a NON-attorney?

I forgot to say, that I do some freelance writing; the other day, I was reading a court case and it gave Laura Hess's e-mail. Did she get an earful from me. Not nasty words, but there could be no question in her mind that I was one of THOUSANDS who didn't think her actions were funny.

Yeah, that is the biggest problem with debt settlement companies. They tell you "don't worry, don't worry, as long as we are in contact with the creditor it'll all be ok" (and that's IF they actually keep in touch with the creditor) but then if/when you get a summons, the word switches to "you're on your own with this one, shall we remove this creditor from your list?" They won't represent you in court, they won't even help you at all with advice on how to respond to the court and what do when you get to court; they just drop you like a hot potato. You really should have gone to court on those, they got default judgments because you failed to appear. Or did you appear and lose? If so, what did you present to them in your defense?
You end up with one of these companies because you are trying to do the right thing and not file for bankruptcy, and then you end up having to file bankruptcy anyway.
If you are going to file BK, it's best to have a decently clean credit report beforehand, so that way your credit score will recover faster. It's not as easy when you have the long space of not paying and going into default before you file.
It's sad :x when the people that swear they're there to help you (for a handsome fee, of course!) only make matters worse for you. :evil: Teamrn, I'm sure YOU would've been better off with that $10k. It's just disgusting...

I have sent faxes, letters, and many phone calls, they have never sent me a post card letter of claim, i have seen on line where people are getting back their money as of march. Now I need mines, who can give me some good information, I am really desperate. Thanks to all.

Hi, I have a lawyer now and will file BK next week after being jerked around by Allegro Law. Last year, Stermer's office sent me a letter that one of my cap one accounts was 'forgiven' and in subsequent conversations with Cap One reps about that and other accounts, they confirmed it was forgiven. I check my report yesterday, and that "forgiven" account shows a large balance, over $4k!! Anybody experience this, or know what to do?

Did you get a 1099? If not, what exactly does that letter say (aside from personal info, of course)?

No 1099 received, but the letter said that it may take til early 09 to show as clear. The letter basically stated he was the receiver for Hess/Kennedy, that this account was forgiven, that reporting agencies would be instructed that the debt was contested until early 09 when they would be able to clear it. It also stated that it affected only this account, and no other cap one accounts we may have. Since it wan't clearing til 09, I assume I may not get a 1099 til next year.

I keep seeing misinformation on this page. The LBF Miami site clearly states monies will be paid back to us BY 12/31/09, not after. It's really quite clear, just go to the site and read it: lbfmiami.com/active_cases_receiverships_hess.html
That page supposedly contains all the information LBF has on this case. They update it about once a month.
Personally I'm really holding out hoping they'll settle with the companies I'm indebted to as they did with HSBC and Capital One. I'd hate to file bankruptcy then find out a month later my debt would have been wiped out... Eeek.

You think the CA Would have some remorse because they were dealing with Hess Kennedy before this shit happend. But they just want there money like leaches. Figures!

Since you are filing for bankruptcy, just put it on there to be on the safe side. I am very suspicious about this situation, I think that this CA is up to something no good. Sounds very fishy. You should have received the 1099, the fact that you didn't makes me think that either you have not told the whole story, or that we are talking about a dishonest bottom feeder here. If they owned the debt and then settled it, it would show as settled just after they reported the settlement to the CRA. That is absolute nonsense that they have to wait for the "contested" note to drop off. There is something shady going on here.....

Consumer Law (Hess Kennedy) has over $18,000.00 of my money. I paid this amount to them over an almost two year period without them settling on even one of my accounts. When calling them to stop derict withdrawals from my account, they continued to take money out of my bank account, knowing that they were on the verge of receivership. I just want my money returned so that I can settle directly with my creditors.
What I have read about possible settlements is that, large creditor, such as Capital One, are getting money from Hess Kennedy before the consumers like you and me. It's 'our' money! Anyone else heard anything similar?

How they intend to pay anyone is beyond me. How does a lawyer take over an illegal business, run it for several months and then pay themselves from the "illegal proceeds"
