If you tell them you are not pernmtted these calls at work they must stop or you can sue them under the fdcpa for 1000.00 per violation. Third party contact is also a violation. Also send them a cease and desist letter to keep them from contacting you any way but by the USPS.
cease and desist letter
Where can I get a copy and how should I send it? Do you know if they actually sue?
Just state in the letter that they are not to call you or anyone
Just state in the letter that they are not to call you or anyone else regarding the alleged debt. Send it registered return receipt. There are letters in the "sample letters" in the side bar of this page. Will they sue you? Not if you sue them first. You already have a case. Are they a law firm or collection agency? Is Joe Pezzuto someone who works there or the name of the firm?
name of firm
It is the name of the firm. I received a letter saying in was Jefferson Capital Systems LLC .the orginal creditor.

Joe Pezzuto
I had a post earlier about Pezzuto. They were calling me at work threating to garnish my wages if i did not talk to them. The OC charged off my debt. Pezzuto law firm told me that collect america bought the debt from the OC. The odd thing is when they sent me the dunn letter it states that the new owner of the debt is Jefferson Capital Sysytems out Atlanta,Georgia. Aspire/Tribute is also based out of Atlanta as well. I think Apsire/Tribute uses Jefferson as middle man to collect the debt.
I sent them a DV letter and to stop calling me at work or home. They call me work also telling my employees to call the Pezzuto law firm for a legal matter.
BTW Pezzuto parctices law only in AZ and i think also MN.
Guy Murphy
If you call 866-826-4101 and ask for Guy Murphy the General Manager he will remove your information and you won't get any more calls! Also they work out payments of $25 a month at times. They worked with me!

i am going through the same s*** with this "Law Firm". they are very rude and keep threating me and my husband that they will take legal action and garnish both of our wages. i live in mo is that a state they are allowed to practice in. i just paid them a payment of 200.00 and told them not to call me back until i recieved my taxes back in janurary and they have prolly called me at least 30+ times in the past 2 weeks. any suggestions?

OK First thing I would do is not panic. Did they use force or intimidation to force you into making a payment? Did they say they where a law firm and say if you didn't pay, they would take legal action? If so DO NOT contact them anymore. That is a violation of the fdcpa.
How did you make a payment to them? If it was by checking account you might think about keeping an eye on it in case they try to steal more money out of your account.
Did you ever get anything in the mail from them? If not, Send them the debt validation letter at the bottom of this post I have included. Format it to your needs and mail it certified mail return receipt requested. Do not sign your name, type it or initial it so that they can't forge your signature later on. Once they get this letter you get the green card back and any calls made in an attempt to collect violate the FDCPA.
Also if you have a record of all the calls they made save them, they will come in handy in court, if they ever try o sue you, you can counter-sue them for a number of FDCPA violations, including harassment, intimidation to make a payment, acting as an attorney when they are not.....Just because they are an attorney in Arizona, they are not licensed in your state so that just makes them a debt collector.
When was the last time you made a payment on this debt to the original creditor? I want to see if the Statute of Limitations has passed on this or not. You still could use that as a defense because you where extorted into making a payment. In Missouri it is 5 years on open accounts, which is what credit cards are. debt collectors will try to say it's a contract 10 years in your state, but they are wrong. Fight that till the end, it's an open account.
Hope this helps.

Re: Acct Ref. # XXXXX and XXXXX
To Whom It May Concern:
This letter is being sent to you in response to a alleged debt. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.
This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you
.
What I need you to provide as the debt validation is as follows:
1. What the money you say I owe is for;
2. Explain and show me how you calculated what you say I owe;
3. Provide me with copies of any papers that show I agreed to pay what you say I owe;
4. Provide a verification or copy of any judgment if applicable;
5. Identify the original creditor;
6. Prove the Statute of Limitations has not expired on this account
7. Show me that you are licensed to collect in my state
8. Provide me with your license numbers and Registered Agent
9. Proof that the collection company owns the debt/or has been assigned the debt. (You are legally entitled to collect this particular debt from me.) This is basic contract law.
10. Complete payment history, starting with the original creditor. (I need to have proof of my payment history with original Creditor, what the amount of the debt was when the creditor assigned the debt to your company, and what fees/interest has been tacked on to this debt and how you/they determined these fees.) This requirement was established by the case Fields v. Wilber Law Firm, Donald L. Wilber and Kenneth Wilber, USCA-02-C-0072, 7th Circuit Court, Sept 2004..
11. Copy of the original signed loan agreement or credit card application. (My contract with the original creditor establishing the debt between us.) This is also basic contract law.
At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau's (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent
I will not hesitate in bringing legal action against you for the following:
1. Violation of the Fair Credit Reporting Act
2. Violation of the Fair Debt Collection Practices Act
3. Defamation of Character
If your offices are able to provide the proper documentation as requested in the following declaration, I will require at least 30 days investigating this information and during such time all collection activity must cease and desist.
Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.
If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.
I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls and calls or correspondence sent to or with any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter by USPS.
It would be advisable that you assure that your records are in order before I am forced to take legal action.

I just started dealing with Joe pezzutos law office on 1/15/2009, The lady i spoke with was very nice and understanding. I told her i wanted to try and take a loan out to pay for it, well i had to have a co-signer through the bank i used and I just got denied on 2/5/2009. But i had a guy call me at work from joe pezzutos office and i politely asked him to call my cell phone number becuase i could not talk on my work phone, he freaked out on me, started yelling and asking why i was so rude, and asked if my parents knew how rude and insulting i was, he said " missy your in a lot of trouble and were gonna get you" he also said that i needed to stop hanging up on him?, That was only the second phone call i have ever received from that company, And the first one was a lady, so i think that they just say stuff to get a rise out of people... I have never spoke to someone like that, he told me that i was making his job impossible, i kept my cool and let him yell and i asked him to let me know when he was done so that i could give him my cell phone number and a better time to call me. He said " unfortuantly thats not how this works missy, i make the rules and you dont. You need to have this debt paid off by today or were going to take legal actions against you to get the money" I got tired of arguing with him and nicely told him that i would call back and talk to someone else who could carry a conversation without throwing insults and hung up. My account is now with my debt manegment program and they accepted it. After they receive three payments from me they can no longer contact me in any way...I just decided not to lower myself to there level, let them be rude it wont get them anywhere but a dail tone.
I have told this company once that they cannot contact me at wor
I have told this company once that they cannot contact me at work and to take my work # off my contact list. I also gave them a better number to call me at. but they are still calling me at work, its embarrassing, is there anything that i can do?
Have you recived anything in writing from them? You can DV them
Have you recived anything in writing from them? You can DV them and state very clearly " All calls to my employer place my employment in jeopardy". Send it CMRRR. If they call at work again after recieving your DV ,log the calls then sue them.

I had several calls from this office. I believe it was them that called my work place a couple days ago. I have got my husband to call them back and say I will call them tomorrow. BUT I am scared to even make the call. I still dont know what

GREAT CALLS for joe pezzuto
OK, So I too have gotten the GREAT CALLS from Joe Pezzuto or whever they are from. The number that they ACTUALLY LEAVE FOR ME to call them back is 1-866-826-4101.
Now isn't that just GREAT of them to LEAVE ME an 800 number for ME to call them back on. Now I am not sure if anyone else out there knows or not, but this is REAL IMPORTANT.
As a former company owner I KNOW for a FACT that ANYONE who has an 800 number or 866 or WHATEVER, AS A COMPANY, they have to PAY for EACH CALL... Grin... Now I am NTO SAYING that you should put that number on EVERYTHING you can possibly think of so that their phone bill will go sky high, I would NEVER DO THAT. However it does seem that it would kinda be funny to see them all of a sudden see a MUCH HIGHER phone bill than normal.
Anyway, the amount that they pay per call is not a significant amount, but let me tell you, if enough people were calling then number thinking MAYBE that it was a free s-e-x number or a Free phone card number or a FREE (use your imagination) number, that would REALLY be a good thing.
Anyway, next time you get a call from them, (hey they ALREADY have your number) keep them online, play with them, have some fun with them, after all not only do they already have your number, and are never going to believe it's not you (even if it is not), but they are the one paying the tab, and what are they going to do, come over to your house and see if you are home. Not Likely or legal.
Anyway, Have fun with them, the longer they are online with you, the longer they are not messing with someone else who might not be able to handle their crap.
Have a Good One,
Dan in San Antonio (or that is who they keep calling anyway)
Your Debtor Rights..... use them and avoid a mess and stress
There are books and on the interent there are "Debtor Rights Handbooks" available on the internet. Debt collectors can call but must only state specific information and they can't call any time they want. You have a right to tell them the means by which you want to communicate, in other words, you can send them a letter saying not to call and that you only want to communicate by letters. This will stop the agressive collection calls that drive us all crazy when debt collectors call. You have a right to send them a "Cease and Decist all Calls" letter. Then just tell them to communicate with you via snail mail. This will give you time to respond to there requests. If you have little money and are unemployed, simply tell them that in your letter. If you are considering bankruptcy, let them know. If you want to settle the matter for pennies on the dollar, make an offer. Really, the best way to communicate with any debt collector is by mail because it stops the rude phone messages and rude collection efforts. If the Debt collector continues to call you, you can tell them they might be in violation of the law because you gave then notice not to call you and to only contact you via email. Make sure to send letters by obtaining a certificate of mailing or proof of mailing.
Really, go to any book store and buy a book on debtors rights and you will avoid a huge problems.
Or type FDCPA into google and read about your rights there. :D

You can send them a letter called a "Cease and Decist all Calls Letter" and mention the phone number that you do not want them to call. You have a right to tell them to "Stop all calls." I believe this is your Debtopr right. Then ask to be communicated with only by ground mail. You can mention bankruptcy if you are going that route or simply tell them you have no money if you are unemployed etc.
Before you begin to start paying any online payments, you had better make sure the debt is owed to these guys. You have no idea who they are and if they can't provide a "PROOF OF DEBT" statement, then question the debt. Contact the original account holders and find out if this company has a right to collect. The FTC, Federal Trade Commission takes complaints against Collecton agencies if they are illegally collecting debts. I believe it is unlawful for collectors to collect on a debt when you don't owe them money. So ask for a "proof of Debt statement" first before paying any thing. Just to make sure you might ask the original creditor if they are handling the account.
It is illegal to threaten legal proceedings, from what I know, they can't tell you to agree to a payment plan or they will sue you, from what I know this is illegal. Consult your attorney about this being I am uncertain. It cost them money and time to sue you so they want to settle and sometimes they will settle the matter for much less than what you owe.

Joe Pezzuto
Wish me luck I need to call this "person" and tell him to quit calling my father in his nursing home. He has no outstanding bills. Everything is paid immediately. I know, I take care of it. He wakes my father up and then he is a bear. So Joe Pezzuto quit poking my bear. He does not owe anyone anything.
Ms.
I received a call from this law office and returned the call immediately. The person (Jeremy) was unbelievably rude despite the fact that I acknowledged the debt and would pay it entirely ASAP. I lost my job; did not qualify for unemployment and have a small fixed income. Told him I was trying desperately to hang onto my home and was unable to send any money right now. The messages since then have been unbelievably threatening and rude. I am almost 70 years old. What can I do?...Thank you.

I am also dealing with this Joe Pezzuto, I live in California I have been told the some of the same things I am reading about. I did recieve a letter from them with the creditor being CACH, LLC and it says Whitehall is the original creditor, I am so confused about what I should. They are very rude and call ten times a day, I have heard about so many debt collector scams I am not sure how to handle this. Can anyone help!

So... has anyone actually found out if he has the ability to file law suits in Florida? or any other state? They call all the time to my cell phone and it has a great feature, if you add them as a contact you can select to send them to VM automatically.. It's GREAT.. The people sending the companies to a VM hell, like most do to us. I love it...

This douchebag has been calling me and making his idle threats for over a year at least, but he actually had the balls to serve my friend a summons last night that was so unprofessional and decidedly insulting in it's obvious lack of any real effort to appear professional or legit. This guy is so out of control that I had to question our county court how they could possibly not just dismiss any of his claims completely because that is THEIR JOB to do; serve us in a way that shows compliance with the law and, well basic and required paperwork that any credit relationship will always have in order to show that we even need to spend a cent at all for it because that is what we are owed, period. He didn't even bother to call him or send a letter. I think it's more than obvious that this completely antisocial fruitcake has been given too much time and attention by people who know better and shouldn't have allowed it to happen in the first place. I work in customer service, and I cannot imagine how this completely incompetent fool could ever have come this far without any basic communications skills or real professional work history. How does the legal system even allow this stuff any acceptance at all when they do everything possible to throw how little they respect what it represents? I find this oversight to be incredibly shameful and lacking in any merit and obviously so, so why don't they just nip these gangster-wanna-be idiots in the bud already? It's so ridiculous that so many people have been needlessly harmed by such completely illegitimate people when such accountable and responsible individuals should have laughed them out of business just on principle, if not self respect and needed respect for what they are bound by law to uphold for us. Don't these judges and clerks even pay attention at all?

Sorry deadbeat. You simply don't get how the system works. It's not the clerk's, nor the judge's job to throw out a lawsuit. it YOUR JOB to raise defenses to the lawsuit, both factual defenses and legal defenses.
