Can Wages Be Garnished if in a Settlement Program??

I am in a settlement program right now, and it's been going great, four accounts settled in just the first year! However, I have an account which has been sold to a bottom-feeder collector that has served me a summons and unless we can settle soon, I may have to go to court. My settlement company has been trying to negotiate with them, but the collectors want 80% in a lump sum. I cannot do this, I have no resources to do so. My question is this: Can wages be garnished, if I have $500 a month going into a settlement program that this account can be settled with? My settlement company is holding off on negotiating other accounts until this one is taken care of, so the money will be there. It's not like this creditor won't get paid, it would just be in four months and not just one lump sum. Garnished wages would take forever and ever to pay it off - wouldn't ANY judge feel the creditor is being foolish to ask for garnished wages when there would be $500 a month available to them through the settlement program? This just seems . . well, . . STUPID on the part of the collector, to go through all this, unless it was just for spite. It's only about a $2000 account. Anyone have experience with going to court on a case like this, when you are already in a settlement program and have funds available to pay the account off in a few months?


i would answer the summons.this sounds like they think they can get something more than garnishment.maybe seize bank accounts,etc.show up and try to get something from your settlement program that they won't work with them.your right, no judge worth there salt will side with the CA if you have proof of willingness to pay.the thing is to show up and present your side.

Oh, I plan to answer alright! My settlement company has been going round and round with them for weeks, and are more than happy to provide me with all the documentation (dates, names of the people they spoke to, etc.). I'm not shy when it comes to telling it like it is, and they are going to get an earful. Politely, of course. ; )

good for you.it seems like they are trying to get it all at once.even if they get a judgement.the judge will set up a payment that is probably less than what you were willing to do.these bottomfeeders are something else..literally.
