Bank of America took my money illegally

Hi all I was hoping for some advise from you. I have been negotiating with Bank of America for lower payments and lower interest. They agreed to 0% interest and lower payments and then we agreed that the first payment would be taken out on Dec. 1st. On Nov. 20th I received a call from them saying they had made a mistake on the date and wouldn't be able to take it on that date and that it would have to be taken out on Nov. 26th. I told them no, the money wouldn't be available at that time. They said that I wouldn't be able to start the program then and we would have to wait until Dec. to re-negotiate another deal. I said fine. Well, I looked at my bank acct. and they went ahead and took out the money anyway on Dec. 1. I wasn't planning on this because of previous discussions and feel that this was illegal activity. Do I have any rights or possible recourse?


Something similar happened to me. B of A fabricated a settlement letter claiming I agreed to it over the phone, which I didn't, as I had no phone conversations with them. Then they faked a pay by phone check and took money out of a checking account. Completely unauthorized. I wrote to the Comptroller of the Cuurrency, and that got their attention.

The only problem is I closed my checking account to prevent them from taking more money out, and now they claim they credited my checking account, but the bank where I had my checking account says I can't get the money once the account is closed.

i also hand the same problem with bofa.they wanted to settle my acct,i told them i would think about it.on 2 differnt times they took money from my checking acct.they credited my checking acct.i then proceded to close my checking acct.it turns out that when my acct cl0sed ,the credit company took money from checking acct.i never gave permission for them to take my money.now my checking was negative,and sent to collections

The U.S. Comptroller of the Currency (no typo this time) is the regulatory agency that has authority over banks. They have a consumer complaint department. Check Google and you will find the address (don't have it with me at public PC right now). Write to them with the complete details, and include copies of any letters, bank statements, etc.

I would always suggest if you are negotiating with a creditor and you have a checking or savings account with them as well, that you make sure to close that checking or saving account or they will and can take money from that account and apply it to your credit card payment.
