I need help with CAN and Payday max!!!!

I just need some quick advice, if anyone could answer me right away, that would be great.

I have a PDL with both Cash Advance Network and Payday Max. I KNOW they are both illegal in the state of Indiana and I need to know how to go about getting them off my back and out of of my bank account.

I owe CAN $390 and have already paid them $90 in finance charges, well over what is legally allowed in Indiana and that was my first extension!

I owe Payday Max $474, and have only made one payment (extension fee of course) of $37 to them.

Both are due to debit my account again on the 10th of December, but I am closing my checking account this coming Thursdays, and the bank has already agreed to put a note on the account stating that NO withdrawals of any kind are to be posted to the account.

Now I read something on here about a letter and some Indiana law, and need to know where to find them, so I can mail both the letter and a copy of the law to both of these creditors.

Can someone help me and tell me what else I will need to do, that I haven't already done?

I want to make absolutely sure these 2 companies ARE illegal in Indiana - does anyone know if they are or not?

Plus - I didn't give them the correct work phone number, but not on purpose. We're moving phones around here and I gave the wrong last 4 numbers. Can this be considered fraud, even though it really wasn't? And now that I find they call people at work, I don't know if I WANT them to have to right number, lol.

I am so scared right now to start this ball rolling, I am just half tempted to keep paying the fees until I can save enough money to pay the loan off all at once!

Can someone help me please? I know, I am stressing out and about to lose it, but I want to make sure i have all my bases covered before I do anything - I can't afford to lose my job if these nutcases are going to be calling work, although the letter says not too and I can't take much stress - I already have heart damage from a past illness. If I die - they won't get anything!

Okay - my checking account is closed, and I have a new one opened.

I haven't sent the letters to Paydaymax or CAN yet, because I am waiting to get their standard "Oops, we couldn't run your payment" email - that way, I can email them back saying "Oops, it looks like you're doing business illegally in Indiana!"

Have I done everything I should so far?

And how do I explain this to my bosses at work, if these companies start to call? I work for a prison and they DO NOT like bill collectors calling and have fired people before for it. I am to embarrassed to tell them about this.

Shazzers - I added the following to my letter - do you think this will be enough? -

I also revoke any and all wage assignments I may or may not have signed with your company, and I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected.

That is exactly what I put on my emails.

What others have done is to go to your boss and inform them that you have had illegal activity on your bank account and you have had to close it and open another. If calls come in for you they are not from bill collectors but from illegal companies and you are working with your bank to resolve it.

You don't know the company as they do not even have your correct phone number :wink:

Well, my next payments on both my CAN and Paydaymax loans have defaulted, as of 2 weeks ago. I got a phone call from Paydaymax - some girl named Latisha stating I needed to get the loan paid now. I informed her I would pay it by money order only and that it would be for the principal only. She asked me then if I liked having a job and I answered if she liked working for a company that was conducting illegal business transactions in Indiana.....she hung up on me. Approximately 2 hours later, I get the standard email response from Credit Protection Depot, saying they want to work with me and to remember, they now loan up to $1000! I sent them my form letter and haven't heard back from them.

As for CAN....I haven't heard one word from them or ARM of Florida.

Now, I did file complaints with the FTC, BBB and the IN Attorney General's office. The AG's office got back with me, stating there was nothing within their legal jurisdiction that they could do for me. Does this mean these 2 companies aren't really illegal in Indiana?
