How many of you have fought and won?

Also, how in the world did you find an attorney to take any case on in regards to consumer debt? I have called everyone in my phone book in my city and the 3 surrounding cities around me and NO ONE will touch it, even though they said I had an excellent chance of winning and a really nice counterclaim!!

I have won....5 times! Twice we had to hire an attorney...we actually made more money using an attorney.
Look for an attorney on http://naca.net/

I found my lawyer using naca however she is 70 miles away. That was the one drawback is that my choices were very limited.
I was surprised that you said no lawyer would touch your case, or do you mean no lawyer would take your case on contingency? Finding a lawyer for contingency is very hard these days unless you have a slam dunk case

I called the only 2 lawyers listed with NACA for my area and they never called me back, called a few times actually requesting phone call back and no phone call yet and yea the closest of the 2 NACA lawyers is over 130 miles away!!! No lawyer near me will TOUCH this case I was willing to pay them but they said not worth their time! One told me I had a case, probably could win on counter claim, but he flat out said the money he would make was not enough for him and hung up!

I got a referral from the bar in my city. Also, I think whether you consider that you've won a case or not depends on what you are fighting for. For example, while I did not win my case so to speak, I was fighting for the plaintiff to unattach to my checking account, which they did. Once they did that, I didn't fight anymore because I know the debt is valid, I just didn't want them emptying my checking account or garnishing my wages.

I called legal aid and was told to try NACA, the phone book, and Internet search which turns up no lawyers to help with consumer credit cases and then the lady said they were too busy to assist me further. Incase your wondering, I do not qualify for legal aid assistance either.Very aggravating. Where are these lawyers??? Why am I having such trouble? I can't emphasize enough the amount of stress this all causes and I thought it would be easy to get a lawyer to help me fight these harrassing CAs. I just do not see me beating these attorneys in court by myself. Those of you who did go to court and won, did you go by yourself or did you have an attorney?

I had an attourney. I had to dip into my mutual fund to get the retainer fee but it was worth it. This year there's no way i can afford the retainer fee since my mutual fund took a massive hit thanks to the current state of the economy.

I found my attorney on this site from another post. He has won two cases for me and made all the other CAs vanish. I am in Florida. We also have an active member called Floridaconsumerlaw who is a consumer advocate lawyer.

I'm in Florida, could you give me the attorney's name and number so I can get help with my case. I have a court date for a trial on 1-5-09. I am doing this alone and the debt is over 7 years old started in 1998. Is there a limit on how long the creditor can sue you for a debt? Thanks

Renee...when was the date of your last payment? When the loan started is irrelevant.

Just had my case dismissed. Main, important point to understand is that the plaintiffs lawyer can not win in court and won't go before a judge if he or she does not have original( or reasonable copy)of statements from original creditor, which you would of gotten through DV if they had them. Case closed so to speak.
