Letter I got from attorney says they were retained to represent XXX but at the bottom says the usual, this is an attempt to collect a debt and any information will be used fo that purpose an d so on. I could had sworn I read a case law or something about this being illegal or some violation.Anyone know a reference and know if true or not? They then turned around and sued me for CA.Trying to find something in regards to this to add to my defense.....

if they include that in the summons.inform the court of that.bring the summons with you.if they include that statement.they are debt collectors.

The law did change that the collection agencies do not have to have a mini miranda after the first letter is sent.

Please provide a reference for this statement.

They are required to say the "mini miranda" *every single time* they contact you.

If they state they are debt collectors (by use of the "mini-miranda") and then declare they are not, then there is something fishy about them. It may even be perjury if entered into by court reference. I suspect that they are a junk debt buyer. Which agency is this and what state are you in?
