Dodeka LLC: Suing people for old debt!!

Today my mom tells me that she's had a letter in her possession for over a month from a lawfirm in Washington 'Weinstein & Riley' representing 'Dodeka LLC' and she faxed it to me
Here's what the letter said

W&R and its local legal counsel have been instructed to commence legal action against you if a prompt resolution of your debt obligation does not occur. The amount due on the day you pay may be greater because of additional interest, late fees, attorney fees and costs. Please confirm with our law firm the exact amount due and owing on the day you intend to make your payment. We trust that you would rather resolve this matter amicably. You should, within thirty days from receipt of this letter, either make arrangements to settle this matter or dispute the debt as set forth below. |
Then it gives me an 877 number to call

I know to DV the company and plan on doing just that. I had no idea Dodeka was now in charge of collecting this account. A few months ago FMA Alliance was trying to get to me but after getting DV'ed, stopped.
Not only that, but they are using an old address of mine when other collection agencies (like FMA) know where I live.
What are my options once I DV them?

Just DV them and make sure to include your current address, that way if they do try to sue you and use your old address, you have proof that they knew perfectly well where you are and sued you at a wrong address on purpose. Be sure the letter is CMRR.
It looks like SOL for this would be 4 years so you are safe if they do try to sue you.

Drjonah...had WI's 6 year SOL expired before you moved to OH? Just asking because if it had, WI's 6 year Statute of Repose would have extinguished the debt making it no longer actionable/collectible.

"Dodeka LLC" is a corporation created by William Weinstein, a partner of the Weinstein & Riley law firm.
"Dodeka" purchases accounts that have been written off by various original creditors for pennies on the dollar - perfectly legal.
The objective of "Dodeka" is either to negotiate a settlement with debtors (you) or reduce the claim to a judgment.
If reduced to judgment the judgment will more than likely be sold to another company specializing in buying "bad paper."
For your consideration . . . contact "Dodeka" and see if you cannot negotiate a compromise settlement.
If you owed the original creditor $1000, you might just get them to accept $500 if you can come up with a lump-sum.
If you need to make payments, you might be able to get $500 - $750 but try to have a couple of hundred for a first payment.
You would not want to sign a "Stipulated Judgment" (meaning they can (and will) automatically take judgment against you if you default on whatever arrangements you make with them.
Also, after you speak with them be sure to let them know that you will want the WRITTEN Agreement, signed by one of their attorneys, sent to you so that you too can sign (and make a copy for your records) and send back to them with your first payment.

I have represented my first Dodeka llc client in S W Mo, and filed an FDCPA counterclaim and sent discovery to them. They have never been able to comply w/ the judge's discovery orders. I complied w/their discovery using their lack of documents that couldn't prove they owned the account or had proof of amounts sued for, w/in the responses, which made them upset as they don't seem to be used to a real defense to be mounted. I have had their pleadings stricken and a default judgment entered on the counterclaim. They didn't even have any local lawyers show up at the last 2 hearings for them.

You want to be careful with that because if they can't reasonably serve you a judge may allow them to serve you via a newspaper in the town of your last known address. If they do this, it will be considered proper service and you will be slapped with a default judgment.

to me it almost sounds like the lawsuit has been "settled" in court, a default judgement. but since you don't know whats going on, you need to call your county clerks office at the courthouse and see what office you need to talk to to find out. has anyone gone to your moms house and tried to leave a summons?
calling as above would be your first step. find out what dates/deadlines you have to take care of this in court, if a suit has actually been filed, who filed it, etc. make you a list of ??"s so you can write down what they say. case # and things like that too.
DON'T call that silly lawyers firm tho. they are just trying to scare you and drumming up business. find out first what is going on. then decide what you want to do legally if necessary.

Check your credit reports ASAP!! Go to AnnualCreditReport.com,,,100% free...only check one report at a time to view....
Look to see what is on your report. Look to see if the original creditor is on there and look to see what debt collectors are on there....it should give you an idea of what you owe and if it was paid or not.
You will also compare your credit report with the summons, look to see the last time a payment was made if in fact it was not paid off, the SOL in Texas, that's where you are right??>....is 4 years.
One you find out if the debt has passed the statute of limitations or not you will then need to file your answer to the summons. You have a time limit usually on that so make sure you read everything, answer to what you feel is best...you do not have to tell the truth, you can neither confirm nor deny...you can deny or you can admit to it...your choice.
Failing to file anything within the time limits can give the plaintiff a default judgment and it is a PITA to get it vacated.
