Most likely a shady pdl or collector. Keep that recording for future reference, next time they call hang up, don't give them the satisfaction of being intimidated. Any legit lender or collector would know better than to record threats such as that.

my suggestion is next time they call tell them you know they are delanor kemper & associates and that you are aware that they are illigally harrassing you and that they are not allowed to call your place of work again. and if they continue to harrass you you are going to turn them in, and in return place them with a law suit. paulmergel is very correct in stating that they cannot put you in jail this is civil not criminal and you are not going to put up with thier abuse any longer and that you are documenting every single time they call and what they say. and then hang up. Be just as confident about it as they are about harrassing you. But be sure to document all times, dates, and exactly what they said.

I know someone said debts are civil matters, not criminal ones, but what the "investigator" told me is they are going to charge me with bad check which is a felony, and then a misdemeanor charge of theft by deception. She couldn't tell me how much the original debt was, so that's what worried me.

I tried today to send them a payment and do you know Money Gram would not let me send the money to Delanor Kemper because someone had been scammed and they didn't want other people tto get scammed also. So is it really or not? Is it a real company or a scam?

Do nothing with them. Do not call them and do not talk to them. They cannot put you in jail for this. If you asked for validation over the phone and they refused then that is their problem. You should report them to your Attorney General if you have information on them. Most likely they are calling you from India or similar, a basement in a basement.

this is just another company trying to scare you into paying them because this is the only way they can get their money. They call me everyday and I do not answer! Simple as that! I created a contact entry on my phone called "Haters" and everytime they call me from a new phone number I add them to this contact entry. So if they call again my phone will display "Haters" and I just decline the call and send them straight to voicemail and then delete their voicemail without even listening to it! ;-) This is the best way to go until you are ready to pay for the debt. Anyway, no one should have to be emotionally threathened and even more stressed out because of a lying bill collector!!! Their should be some kind of law to prosecute these low lifes! You can't go to jail for being broke! They have been calling me everyday for a year now. I never answer! It it was a criminal offense I would be in jail by now! Remember being broke and poor is not a crime (yet). :-/

listen, you absolutely will not go to jail its civil not criminal the worst case scenerio if it is a legit company, but i doubt it is due to the post saying that money gram wouldnt allow the payment(Screaming red flags) you would get a summons to appear in court and the judge would issue as to how you would have to go about paying the debt.

They are going to put me in jail, they are going to attach our wages (come to find out recently my state has a no garnishment law), they were going to come to our home and take our things, They would have a judge withdraw it from my checking(yeah ok good luck with that), We dont work with settlement companies (even though everyone of them did),

For what it's worth, you are SO not alone! I get threats on a daily basis. And not even from CA's. The threats I get come from the credit card company themselves. They operate with complete immunity. They have directly threatened to send a SWAT team to my home to kick in the doors and a lengthy prison sentence in the toughest prison in the country. They have indirectly threatened violence and even death. If being in debt was a criminal matter (which it is NOT), the jails and prisons would be more over crowded than they are now. In fact, they would have to build new prisons to incarcerate all the people in debt. Then, the nation would be practically empty! That's how many people are in debt. The CC companies collections departments are NO better than third party collectors. And the FTC or whoever the hell is supposed to regulate them sits by and does nothing. Despite what the CC companies and the CAs tell people, I have YET to see or hear of ONE case where an individual has ended up on Riker's Island due to being behind on a debt. Or for that matter, even ended up in cuffs! It's not a criminal matter. Period.

I mean, to treat you this way, obviously breaking the law... are they accusing you of fraudulent charges or something? Did you do a large balance transfer to Citi, make one payment, then stop paying? Not that this gives them the right to break the law, but clearly they are upset about something.

As a matter of fact, the calls intensified. I told them that I was on a payment arrangement. They said that a payment arrangement is merely to "stop the bleeding". They needed me to get current and get current RIGHT NOW. I told them that was what the payment arrangement was for. They said no, I was wrong. I would then tell them that I didn't know what else to do. They got infuriated. Started the law enforcement talk. I told them I knew good and well that debt is a civil matter and not a criminal matter. They told me I was wrong about that too. Finally, I would just hang up. The calls I have received since getting on the payment arrangement have gotten worse and worse. I have written them a letter asking them to only call my home phone and NOT my work phone. They ignored that request. They have made some terrible, outlandish threats, up to and including prison. When it comes to collections, be it 3rd party or in-house, they're all the same. The latest incident occured yesterday while i was at work. i got a call at work (after a letter asking them not to call me there) and they told me that the actual sheriff in the jurisdiction I reside in told them to tell me that he will send a team of law enforcement officials to apprehend me at work if I do not comply with the CC company at once. I guess that's what they meant by a "sheriff's warning". Did I get behind on paying them? yes. But, I am on an arrangement. Yet, they are telling me that it's not enough. If it's not enough, then they never should have offered the arrangement to me. I know I will not go to the slammer or anything, but the calls and threats are worsening by the minute it seems. They have made it their mission to get me.

I'm sorry you're going through this, but it's somewhat entertaining because Citi is treating you in such an outlandish way and completely violating your rights. I just didn't think that an OC would subject themselves to this potential liability.... they WILL get sued for treating people in this manner. It's just a matter of time. And that can only exacerbate their financial issues.
Also, you should definately invest in something to record these calls. Find out if you are a one-party or two-party state though, because in some states you have to tell them at the beginning of the call you are recording them (some states you don't have to state it). Just by virtue of telling them you are recording the call, that should clean up some of the illegal behavior.
Did you get anything from Citi in writing, regarding your payment "arrangement"? I'm afraid that if you didn't, you might be making payments that ultimately aren't ever going to make you current... which could explain why the collection people are still calling you.
Also, have you asked the collections people if they are Citi employees? It may be a 3rd party collector used by Citi, where Citi still owns the debt, but they outsourced the collection side of it. This way Citi can avoid some liability for the way you are being treated (maybe). And maybe Citi didn't communicate to the collection folks that you are in a payment plan for the past due amounts. Have you called Citi directly (not the collections group) to ask why you are still receiving collection calls? Maybe they are unaware you are still getting collection calls?
I'm by no means an expect here, just some in a similar situation (albeit with more cordial dialog with my creditors). But if you are being treated this way, you need to document all of it, dates, times, what they said, who you talked to, and record it if possible. By no means should you or anyone be treated this way.

by a cheapo notepad and document all these calls who you are speaking to what time of day it is and were they called and what they said exactly. I also agree that maybe you should find your state laws on recording the conversations. and if you cant maybe record it for your own personal use so you dont forget what they said and can right it down after the phone conversation.

I also received a call yester day at work but the recvpentionst has been informed by me that if they ask for my last name to tellthem I am not allowed to take personal calls, right after that my call rang , same people, said they were lawyers and toc all back. never did, got another call on the cell today and she said she was a lawyer and this is in refence to a check fraud. gimmie a break i have a payday loan i haven't paid and closed out my account. screw these buttheads i was kinda nervous until i found this site and seen they ar just bill collectors with big balls or so they think. I just received a call from this company too. The man that spoke with me was Mr. Darden, who's title is Senior Manager. He's had been calling my work but i didn't know what it was in regards to. When i called hi back he immediately asked if i had been summoned yet???
When i asked him for what? he proceeded to put me on hold and tell me that he was in court all day. Finally he pulled up my case number and said it was for a payday loan and that he was about to send my file to the courthouse. First he wanted me to pay the amount in full and they do not accept payments. Then he was willing to take half of the payment now and the rest in 2 weeks. Finally he said i could make a payment of $200 every pay period, but i have to give my debit card info. I told i didn't have a card on me so he advise i have to call back on monday to give him the card # or i'm going to court for check fruad. Is this company for real?

I do owe debt. 5-6 years ago my family went through a traumatic life altering event. I went from two incomes to one and am not working now. I told this to the creditor North Star is their name, but they are ruthless. Tried to tell them I am starting a class that will enable me to find a job, but they will not listen. Do not know what to do anymore? I cannot afford a lawyer if I wanted one andthey will not let up. Even when I was working I was hardly getting by let alone paying these extra bills. Was either have food, heat or pay them. Their number is 866-328-8252 and I cannot find an adddress for them. Any advice or help would be so appreciated.

Never admitt you owe the money. After 7 years you can have the bad debt purged from your credit score at all the major credit agencies. Do not pay. It will not help your credit score and never admit you owe the debt. Just say the statute of limitations is up and it is now a non issue or issue for the courts to decide. If it did not go to court before it surely will not now.

Regardless, expiration of SOL does not make a debt uncollectible unless you live in MS or WI. SOL is an affirmative defense to lawsuit only. An unpaid debt is collectible until you die. Now why would we here on this forum advocate not paying a debt owed. I understand people fall on hard times, but just giving advice to lie in court about a debt is HIGHLY wrong. I agree with Nascar_D, your information is hollow and can give newcomers here the wrong impression :?

You do not have to pay ANY Debt Collector. There is no court action beyond 2 years, out of the statue of limitations.
These are scum bags who harasse and intimidate whether you owe any money or not. They should be paying you for the harassement, intrusion of privacey and emotional upset.

my husband has recieved many calls from them telling him it is urgent about his account. we never called back. we got in the payday loan trap, had issues with our account, it closed, we let it go till people called us. well we dont know who this person is. it is an out of state area code, no 800 number. they called him at work, and threatened to sue him if he didnt make payments, higher than we could afford, but he set them up anyways....i had looked them up online and seen bad things posted abt them, but he didnt remember their name, or they gave him a different one. so now what? they used bad tactics to threaten him to pay something we arent even sure we owe, because u know how these payday loans start out as one, but are really 2 or 3 other names that u never saw before,and when u are in need u never look at that. we were stupid back then, but now have to be vigilint. i know there are crooks out there, and we dont have the money to throw around.

I had to spend 3 days in jail once for an old unpaid payday loan, so when I got this call I was super worried! Fortunately I found out the true colors of these scumbags thanks to a little research and this forum. I would like to star a campaign to get any form of payday lending completely outlawed in the United States altogether! It is quite simply legalized loan sharking and takes advantage of the poorest people that are unable to get traditional bank loans! One bottom-feeding group that generates another in the form of these dishonest bill collectors! Yes, I got a call from Delanor Kemper stating that they were an investigator also. I put this collection agency in with the Better Business Bureau. Don't worry a collection agency can't take you to court due, to the fact they are not the owner the orginal debt that they are tring to collect. Find out in your state what is the statue of limatations is as well. Like you said, they are jerks.

Which in turn the Fedral Government in my state have shut down all the pay day loan offices due, to the fact they where over charging intrest on the loans. I have put them in with the Attorney Generals office in my State. Keep this in mind if any collection agency tries to collect on a debt from you they must be the orginial owner of the debt they are trying to collect. What the collection agency do is they buy up your old debt from the orginal owner that you own the debt too so that they can make monies from your old debt. Other then that they all can go to HELL.

Also, keep a log how many times that they are contacting you.
