Harrasing Bill Collectors.

Lying idiots
I received a call from these people too. It's interesting. He said I committed credit card fraud which I would never be stupid enough to do. I think it's just another collection agency trying to screw people. I refuse to call them back.
Scam/Fraud
Hi, I have been reading your post on the associate Company if they are impersinating a investigator or even requesting money you have a legal right to know what for. If they do not answer you can file charges against them. If they are a true collecter they must anounce why they are calling you in most states in the US. Its a law!
Delanor Kemper: Are they a scam
OMG!!!!! They have been calling me this week. And then they put their "lead investorgator" on the phone who was very rude. They said that they are issuing a warrant for my arrest if I do not send the money today. They gave me a money gram code to send the money and when I went to send it; it would not go through. WTF!!!! They threatened me with sending me to jail, called me a lair. They got me so mad that I started cursing at them and told them to suck my d@!k

It's a scam! You cannot be charged with any crime, arrested, etc., simply for owing money. There are several serious violations of federal law in what you posted above:
- A debt collector styling himself as 'lead investigator'.
- Claiming that you a warrant will be issued.
- Claiming that you will go to jail for owing money.
- Abusive language.
Any of these is actionable by you under the FDCPA. Record their calls, if that's legal in your state. At least keep a written log of when they called, who called, and what they said.
File complaints with your attorney general's office, the Federal Trade Commission, your police department, and your telephone company (for abusive language/profanity/etc.)
Here are some tips for you to consider:
- Never pay anything based on a phone call. Insist on proper validation in writing. This is your right, under federal law. Check it with us before paying if you're at all uncertain.
- Never pay anything to a collector by moneygram. These people use moneygram because once you realize you've been had, you can't get your money back.
- If you are confident that you are paying on a legitimate, valid debt, send them a money order or cashier's check only. And only through the mail. Do not, under any circumstances, give them anything with your banking or credit card information on it.

I also today received a call from them stating I was being investigated for fraud and that they have photos of me taking the money and not paying them back, what was really funny though was when I returned the call and spoke to a Mrs Paige I asked her what this was all about she hung up on me me not knowing called them back and told her that what she did was rude and uncalled for and that I was looking to take care of the matter, she then went on to explain to me what it was about, I then told her I would only pay them upon receiving a statement of witch they could not do. It seems to me that if we joined together for a mass law suit maybe the we can make some kind of change. Just a thought!

Yes, they try to get money out of people right there on the phone. Honestly if they threaten you with any sort of arrest and/or jail...you know immediately that they are either an outright scam or the lowest of the low of debt collectors. Do not deal with them at all. Tell them to send you a letter (which by law they must do within 5 days of initial contact) and then handle it with debt validation letters.
If they say they are investigators, call them on it because they are most certainly NOT.

Yeah, do what soaplady suggested. Don't worry about it, they are completely BSing you...they are trying to scare a payment out of you. Don't fall for it. Send them a debt validation letter and inform them you will only pay a debt that has been properly validated and if they were legitimate they should have no trouble providing you the info and that you will not stand for illegal collection tactics or any violations of your rights whatsoever.

Most CA's dont give a hoot about BBB complaints...they are a letter writing company...they have no legal enforcement. Try the AG's office or FTC.

Yeah I was just going to say that as well! The BBB is just a private organization with no authority to do anything, definitely not the authority that the AG has! Heck, if a CA has a bunch of complaints with the BBB a person who wants monies collected might just think they must be doing a good job...as far as I know there is only one state (Texas) where it is a violation to use a CA that knowingly breaks the law.

Yeah, I got a call from these people today. First they called my office, then I got their phone number (678-500-8439) and spoke to Ms Malone. I had originally had a PDL from SGQ Ltd for $300 in 2008. Some folks here helped me write letters revoking the ach authorization on my PDLs in mid-2008. I sent them the letter at that point and made several attempts through phone and mail to contact them to clear up the balance I owed. They never replied to any of those attempts.
Now the phone call I received today says that I owe over $1000 because not only are they trying to collect on the loan, but they are also charging me for collection fees?! I asked the woman how that worked and where in any contract does it state I'd be responsible for collection fees, and she said that since I "disappeared" on them, I had to pay those fees as well. She also told me at one point during the call that they had been trying to contact me since '08; I said this is the first time I've ever had anyone from this organization contact me and she said she just got my "file" today. Doesn't make much sense.
I then said I had no problem paying the balance of my actual loan, but I wanted to see debt validation from them since I have no idea who they are and want something to verify the information she's giving to me. She said she could fax something to me to settle the debt, with today's date on it, and it's only valid for today. I let her know that I wanted the debt validation first and I wanted to see all of these "fees" I was allegedly responsible for paying. She said that she didn't have to provide that to me and when I told her I am required to receive that under federal law, she hung up on me.
The thing that kills me is: I have NO problem paying the $250 I owe to SGQ Ltd. They gave me a loan, I know I need to repay it. But they have never given me the ability to do so or even given me an address or contact to whom I can send a bank check or money order.

Received a call from 678-534-8007 Lori Davis from Delanor Kemper saying there was a fraud claim about to happen in our county. When my husband returned to call to Miss Lori Davis, she changed her story and told my husband that he had cash a bad check at a bank he has never went to (do not even have American Bank in our town) and they had him on surveilance. This place is a scam - BEWARE! I called this Miss Davis back and questioned her motives and she ended up hanging up on me. Please do not give out any information to these scam artist.

So, my conversation with them was fairly pleasant - - however I still don't believe all of what they say is true. She DID offer me a case number, she DID tell me the amount and who it was ORIGINALLY from (payday loan), and it IS valid. HOWEVER, they will ONLY accept a payment over the phone (I told her I don't have a credit card, she recommended I get a 'green dot' card - reloadable debit card from walmart) & even just call her back with the number - and just load money on is "as I can" to make 'payments'. I kept asking her why I couldn't just send in a money order - she said they only do it electronically. I've read through the rest of these posts - and I am scared of this stupid company. I read one post that said I shouldn't pay any money to anyone who is NOT the ORIGINAL company that I borrowed money from. I am confused though - why did that original company send it off to these people then??? And should I NOT pay them anything??? It IS an actual bill that I DO owe; but I just don't understand if I should pay & who to pay???? I'm lost. She also says there's a court date scheduled in my county for this....in July. Anyone have any input???
Have you checked you county court dockets? Have you been served
Have you checked you county court dockets? Have you been served a summons?
By law you are entitled to send them a DV to verify that they are authorized to collect on the debt. Get an address....dont pay them a dime until they have validated.
Delanor Kemper - Mr. Webb
Today he called my workplace asking for a coworker. He said it was in regards to his social security No. being red flagged. Im very happy I found this forum. I just had to write my comment.

Is that true that a collection agency can't take you to court? I was under the impression they could if they bought the debt...

Most collection agencies threaten to sue, and most don't have ownership of the debt to do it. That is called "standing". If they buy it, they can sue, but most likely they will lose because they can't prove anything about the debt. As for looking up court dockets, in most jurisdictions you can go to the court clerk and do a search for your name. Some even have search capabilities online. I wouldn't do this every time a debt collector threatened to sue, because most of the time they are lying.

It has got nothing to do with ownership....simple fact....collection agencies CANNOT sue. They are not attorneys nor do they have the capacity to do so. Accounts have to be transfered to a collection law firm in you county for suit...that is when you should start to worry.

If they are directly or even indirectly threatened violence or death, that would be deemed terroristic threats and is highly illegal. I would be consulting an attorney asap for any company that does that....doesnt matter if it is a credit card company.

This company called me an hour ago left a message for my husband that they needed all call back because some fraud was committed against him. I looked up the number on caller ID and found all this, we are prepared to deal with this investigator now, they picked the wrong man to call.

I just got a call from these Delanor Kemper people and they said that if I didn't pay the whole amount that they were going to pursue legal action for a check that I never wrote. Plus they said that I would server prison if I didn't pay this immediatley. I have 3 kids to worry about. Are these people legit? And to top it off they wanted my Debit Card number. I hung up when they asked me that.

they for one can't have you arrested for owing a debt.in fact they broke the law in threatening that.file a police report for that, and then ignore them as they never send anything in writing so asking/demanding it is pointless.bottomline a lawbreaking bottomfeeder that needs to be reported not paid.

That is correct. it is against the LAW for them to even threaten that because it is not true and the law specifically prohibits collectors from using any threat they can't legally follow through.
Let me guess...it was a payday loan type thing where you gave check info...well that is NOT writing a check at all and you CAN'T be held for criminal activity with this..at all. All they could legally do is sue you and if they do, you have a nice tidy little counterclaim....should be able to get some back from them...threatening a mom with jail when it can't happen..they broke the law big time.
delanor and kemper
well i had a payday loan for 600 dollars my husband was out of work for 8 months and i couldn't pay it right away by the time i did get some money to pay on it they called me at work and said i owed 1600 dollars and that they were going to prosecute me for bank fraud and that i should bring a lawyer to court with me to make sure i could post bail. i immediately agreed to pay 100 dollars a week and after i paid a little over a thousand dollars they said they weren't looking to drag it out week after week and that i would have to pay it all in a short period of time. imagine my horror when they told me i still owed 1400 dollars because they had to add fees and interest. i struggled with making the hundred dollar a week payments. but what do you do i sure don't want to go to jail. but it is delanor and kemper that is taking my money as fast as i can make it. i believe the government probably owns these pay day loan centers how else could they get away with this?
No the government does NOT own these pay day loan centers. What
No the government does NOT own these pay day loan centers.
What state are you in? Are these loans even legal??
