So I got sued by a collection agency that I have found out buys junk debt and goes after people. I decided to contact them to negotiate a payment rather than take it to court. I agreed to pay 3300 on a debt they were asking 3709 for. I posted this a while back and many of you thought I was offering way too much... well I set it up in July to start paying in Sept. I had my hours cut at work so I didn't start paying until about a month later. She sent me an email stating that my new balance was 4125 plus interest.. so I asked her what happened to the 3300 and she said it was null and void because payment wasn't made when it was supposed to be. Keep in mind that this credit limit was originally for 2500. A credit limit I never evem REACHED. I hit maybe 1800 and started having mail rerouted by my psychotic ex. so now i'm not sure what to do. They're charging 2000 more than my credit limit... I understand interest and all that good stuff, but good lord.


Ok, the company is Providence Dane-David Ashe. This is an account that went delinquent in '05. I'm in VA. They did sue but I found out the day BEFORE court- ON ACCIDENT.. that's when I agreed to pay the 3300 amount and they dismissed it. They're being shady about this new amount and I checked this morning on the court website and I saw that they filed another court date that has already passed. AGAIN no one provided information regarding this. It hasn't been updated to show what happened, so i don't know if a judgement was made. I pay bi-weekly..so my last payment was Friday.

Immediately contact the courts over the improper service. Before they can initiate another suit, get a DV letter out to them asap, certified mail return receipt. Demand to see all documentation that shows how they get the amount owed such as the last statement and also the signed contract that states they can charge you the interest they are.
