Alright I have called 2 day loan lenders recently attempting to tell them I am unemployed. The only reason that instigated this was because they called threatening to garnish wages on a job I don't have.
So the two lenders that I have loans with are Payday Loan Yes (most agreesive) and Outback Bucks.
(Pay day Loan Yes)
Well I called and got a bit agreesive with them telling them the interest rates were way too high and needed to be knocked down. (She hung up)
Called a second time and also informed her I was umployed and the account they had was claused. She then threated to prosecute for a bad check. I called her bluff, she then said she was going to do what she was going to have to do. Which said she was passing a bad check across state lines which was a felony. (Hang up)
I suppose I wanted to get this off my back by agreeing to send a money order. For the original pay day loan amount plus fees and maybe I felt nice a bad check fee.
Well this getting hung up on is getting a bit old.
So as for the other one haven't heard one peep out of them yet but am expecting to and am curious as what to do. Any thoughts?

In Iowa Internet payday lenders are not legal, either because of restrictive laws, or because the state does not license companies not located in that state, but requires a state issued license to lend.

I hope the information below will help you. :)
You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender.

What should you do?
Close your account asap, if you are unable to close your account, go into your bank and ask to speak with the Branch Manager, tell him/her you need a hard debit block placed on your account immediately! Explain that you are revoking ACH authorizations from unlicensed/illegal companies, and have learned these companies are notorious for ignoring revocation, therefore it is important to BLOCK any withdrawal attempts on your account to protect your interest. This is your privilege, do not accept no for an answer. The following link will provide you important information regarding closing accounts. CLICK HERE

What next?
AFTER your account is secure send each pdl (the unlicensed and illegal) an email similar to THIS (please scroll down to locate letter template). Tailor this letter to your needs, and try to write it with the same basic concept in your own words. You will need to research and locate email addresses/physical addresses if you don't already have them, I suggest that you type the name of the pdl (example: "oneclickcash address") in the search box in the upper right hand corner of this forum. You may also search for addresses HERE at the Better Business Bureau.

File complaints: Most of the time, you can file a complaint online with the following, I encourage you to follow through with doing so, you will need to search the Internet for your state Attorney General's website, however, here are links to file complaints for the FTC, Online complaints: Federal Trade Commission., and the BETTER BUSINESS BUREAU.

Keep in mind that you may not receive a response for days, or even weeks, or, you may receive harassing and threatening phone calls. I have found the best way to deal with this is not to respond or reply, simply hang up.

Side note: If you have paid an illegal/unlicensed payday lender above and beyond the principal amount you borrowed, it might be a good idea to demand a refund and a paid in full letter/receipt. You may or may not get one or both. It still doesn't hurt to include that tidbit in your letter. :)[/quote]

I work in one state (MN) where I originated the internet loan and I live in another (WI). The laws are unclear in WI - basically the company has to be licensed to collect the outrageous percentages - but they don't really talk about Internet borrowing, only regular payday loans. GFS and IC are both out of the country - they are a pain to deal with and have very deceptive practices for calling people (the same person will call with many different names....). Quickest cash advance uses a collection company in Kansas - so they are a little better to work with, but still - none of them will accept partial payments to settle the accounts (I've been trying to do so for a couple of months)! I didn't file them on my bankruptcy last spring because I wanted to pay them off - knowing that I was the one that took out the loans over time - and other circumstances have led to not being able to pay them off until my taxes come back next year (2009).
Which law applies to the loan - WI or MN?
ALso - the one guy that called kept asking about my personal references. Since the original loan was taken out, one of my references has had a stroke - how can I get them to not bother her? They also have threatened to garnish my wages, but the payroll department where I work will not allow it. I've tried explaining this to them and they continually harrass me at work.
What do I do?

oldandintrouble, WI laws pertain to payday loans. As for Quickest cash advance, they are not licensed in Wi, therefore the collection agency is collecting on an illegal debt. However you will have to pay back the principal only. Don't let them talk you into paying anymore than that.

Internet lenders HAVE to be licensed in the state of WI.. period regardless of where they are.

If you have any question don't hesitate to contact WI DFI. They are great to deal with and will answer any of your questions. I have them dealing with Check'n'go.

Cheetahwind,

Just pay them the principle back. There is nothing that they can do and unfortunately since internet loans are illegal in Iowa, the state can do nothing to help (This comes straight from a conversation with the Iowa State Auditor on Tuesday). Pay nothing more than the prionciple and as long as you live in Iowa, DO NOT borrow on-line again. If you should get into the position of needing cash, go to a legal storefront. They will be licensed by the state and you will pay approximately half what you were charged in the internet!!

oldandintrouble,

If your loan was at a storefront, you abide by the laws of the location of the store. If it was internet, most of the time it is the laws of your residence.
