Ameriloan told me they are leagal

ameriloan told me they are legal in Nebraska because they are an internet company and they do not have to follow Nebraska laws is this true. They would however come up with a settlement because I am offering to pay, even though I have been paying since June. Any thoughts? Thanks


Should I go ahead and make the payment that we set up over the phone. By the way they called me at work even though I requested they not do so in a letter I sent them as follows

To Whom It May Concern:

It has been brought to my attention that your company is not licensed to lend in my state, Nebraska Statute 45-901, therefore it makes the contract I had with you null and void. I will agree to pay the principal amount of the loan; however, I will need a physical address to send payments in the form of money orders. These are my terms, if you are not willing to accept my terms, then you will not receive any payments.

You are hereby notified that I am revoking ANY and ALL ACH transactions made by your company on any of my personal accounts. If you make any attempts to do so, I will be forced to take legal action against your company. I am also revoking any and all wage assignments I may or may not have signed with your company; my employer has been notified about this matter.

As of today December 17, 2008, the only contact you may make with me is either through email, or USPS. I also demand your company and any affiliates of your company cease and desist all contact with me (except what is stated above), my employer, or any references I have listed on my account.

Your cooperation in this matter is appreciated

As long as you are ONLY paying back the principal amount, make sure you send them payments with a money order or pre-paid visa, I wouldn't allow them to have my bank info, they will drain you dry, they can NOT be trusted. I hope you have an agreement in writing? If not, I wouldn't give them another dime until you have something in writing stating amount owed and payment agreement, otherwise you may never get this paid off. Illegal companies can NOT be trusted, that is why they're illegal. :shock:

from the looks of it you have overpaid.any of there supposed fees go toward the loan.at this point i wouldn't pay them a dime more and seek a PIF.file AG complaints if you have to.

AG=attorney general.file with the OK and NE AG'S.seek a PIF from this illegal lender.

you can file the same complaint with the AG as the BBB.as far as points go.you earn points for just about every post.when you reach 1000 you can redeem them for payment.

Does anyone know which form I fill out for the Nebraska AG? Sorry to sound so "newbie" to this.

Also does anyone have an example of a letter I can give my payroll?

shazzers comes through.use that and give a copy to your HR or payroll person before sending it to ameriloan.

I have had a previous loan with Ameriloan that I just recently paid off. They keep emailing me and calling my job to resign with them. I refussed the offer. They still have all my information from my prvious loan. Can they still debit my account without my consent?
I have read all of theses horror stories now and i am affraid that they may do this to me. Even though I never had any problems with them, i'm still affraid that this will happen.
