Deferred Presentment in Michigan and Bankruptcy Law

I was in a repayment plan with Advance America. I was due to make my second payment and was told by my Bankruptcy attorney that I did not have to continue making payment. I was told to notify Advance America that I had paid for my Bankruptcy and asked the manager at that location if she wanted a copy of the paid receipt. She said "Not necessary."

I came home today and found that she had presented my check today, after being notified that we had filed. I work in the industry and know that my company does not present the check after being notified. Did this manager of Advance America break Michigan Deferred Presentment laws by taking my check to the bank?


I both emailed MI state office governing our Deferred Presentment laws (OFIS) and forwarded a copy of that letter to my attorney.

I work in the industry and our company does not do this...we follow the laws very closely. The infraction fees for breaking the laws are very high and I was surprised by this action.

Thank you for any responses I received. This issue has been resolved. The report with OFIS has been noted and filed.
