You havent used it in six years...after 2 years of not using I would have sold the darn thing.

How much do you still owe? Each state has different laws regarding wage garnishment. Depending on your state, the balance has to be at least a certain amount in order for them to place a wage garnishment on you.
Also, do you have to have them sell it or can you find someone who is willing to take over the remaining payments and you can wrangle something yourself? I don't really know how timeshares work.

we have paid $200 towards a down payment which is $1400 and signed loan papers for $24000. what happens if the down payment can not be met

We kinda had the same thing... we bought a timeshare 8 years ago and sighned to pay $199 a month for 10 years. Then each year they send us the fee for maint. It started at $299 but had risen to $1250 this year. We finally said F-- it and did not pay the maint fees. We also stopped paying the $199 a month. We got a call from them asking why we stopped and I told them we cant pay for it anymore. She talked to her manager and said they would take it back. They sent us some papers to sign saying we sign over everything to them and we no long owe any thing. So we got rid of our $1250 bill and about $4400 still unpaid on the loan. I am still not sure why they made it so easy for us to get out of the contract. But if you look on E-bay there are like 1000 people selling timeshares for $.1 to $1 dollar just to get out of the yearly main fees. So I am not sure that $500 is money well spent. And so far nothing had been reported to any credit bueau.

I know of a company named Timeshare Mortgage Relief that can legally break your timeshare contract without hurting your credit. You can find them online if you just Google their name. They helped me and I am well pleased.
