Got a call today
Date: Thu, 12/18/2008 - 18:41
So about two min. later I get a call back from this female phillips, she says a warrant was set on her desk that a warrant was going to be issued in kaufman county texas tomorrow for me if I did not contact this Mr. Ross. OK so I contact this Mr. Ross tell him who I am and ask him what the deal is. He tells me that they are going to issue a warrant for my arrest tomorrow if I do not pay restitution for check n go for the amount of 2,497.18. I then ask him if I can make payments and that I need an address to send to. He continues to tell me we do not have an address and we do not have a payment plan. He said I can pay by debit card, told I dont have a bank account. He then continues to tell me that I can go to walmart and buy a reloaded visa card get back with him today with the number and that would stop the warrant.
I was also told this was check fraud. I asked to define fraud, lol, I was told that in the state of Texas I wrote this check to them and forgot to read my contract that it stated they could get me for check fraud. I told him I would not consider this fraud as I did not sign someone elses name on another check or steal checks.
There are two things that caught my attention. First off if there was a warrant going to be issued for me it would be in the wrong county...as I did not get the pdl in Kaufman county, I got it in Henderson County. #2 caught my attention when he told me he could reduce the amount to 1,400.00 and that I could load a visa card with 700.00 for two month or two month payments. LOL!!! I said ok I'll be calling you later today, hung up and laughed at him.
This loan has been out for two years...and check n go has already set me in the CB for the exact amount they quoted above the 2,497.18. I didnt think if you where put in the CB they could pursue a warrant for your arrest??????? Plus I called henderson county sheriffs office and read him the warrant number and he said that texas warrant numbers are 16 numbers across, and that this one they gave me is only 9. He did say though that it looks like someone is trying to scare me, but that I should call the fulton sheriffs warrant division tomorrow, see if there is a Investor Phillips and see if this is really a warrant as GA could be only 9 numbers long. I intend to do that and will get back with ya'll on it.
I am putting the phone numbers in here to see if anyone else reconizes them and the names of the two ppl. There is a fulton sheriffs dept. out of atlanta Ga. but when I pull the phone number up its totally diff. from the one I have. when I put in this other number there is nada! and the second number comes up as a cellular phone, no name.
here it is:
Investor Phillips (404) 705-7205
Mr. Ross (678) 760-9846
warrant # 00212076
company name: chase and associates
If anyone reconizes these numbers or names please let me know.
I would call the Fulton County Sherriffs Department and give the
I would call the Fulton County Sherriffs Department and give them that number. They might not appreciate it much that a bottomfeeder is doing that.

I found this info on this site.
Texas payday loan laws
I found this info on this site.
Texas payday loan laws were first enacted in June of 2000. As with other states, Texas payday loan laws state that a lender must obtain a license before they operate. Under Texas state law, a company that engages in the business of payday loans is defined as any person(s) making cash advances in exchange for a consumer????????s personal check, or in exchange fore the consumer????????s authorization to debit the consumer????????s deposit account. The licensing laws for payday loan lenders in Texas are the same as stated under the Texas Finance Code Ann. 342.
Texas payday loan laws have different requirements on fees than other states. Under Texas law a lender is allowed to charge no more than $1 per $5 that????????s borrowed for loans under $30. For loans over $30 but no more than $100, a service fee of one-tenth the amount can be applied. And for cash advances over $100, a fee of no more than $10 can be charged.
Texas payday loan laws also permit handling charges in addition to service or interest fees. Under Texas law, a $3.50 handling charge can be added each month to the total amount as long as the amount of the loan doesn????????t exceed $35. If the cash advance is over $35 but no more than $70, monthly handling charge of $4 can be applied. For loans over that amount, a $4 fee can be added each month for every $100 that????????s borrowed.
Payday loan lenders in Texas must post a notice with a fee schedule along with a written agreement. The agreement must contain the name of the lender, the transaction date, the amount of the check, an itemization of fees, the earliest date the check must be deposited, and a total amount expressed in U.S. dollars and as an annual percentage rate. The agreement form should have the name, address, and phone number of the Consumer Credit Commissioner. Texas payday loan laws also require that the agreement form provide a notice that sates payday loans are intended for short-term cash needs.
Texas payday loan laws prohibit lenders from dividing one loan into two loans for the sole purpose of collecting higher interest fees. The maximum term limit for payday loans in Texas is 31 days. The minimal term limit for payday loans is 7 days.
Under Texas law, a lender cannot pursue criminal charges to collect on a debt. Also, a payday loan lender is limited as to how many times a loan can be renewed. Currently under Texas law, lenders are allowed to renew a payday loan one time each month.
So there is no warrant.
As NASCAR Devil said I would call the sheriff and tell them that a collection company is using their name to try and collect.
I'd say if the company is using the name of the Sheriffs' Dept.
I'd say if the company is using the name of the Sheriffs' Dept. in order to try to get money, that's a definite case of fraud and the Sheriffs' Dept. might want to prosecute them for that.
BIG mistake using the sheriff's name to scam money!! There used
BIG mistake using the sheriff's name to scam money!! There used to be a company in Chicago that tried that and subsequently was put out of business with all of the fines. The sad part is that it was not the company direction, but an overzelous store manager that commited the act. I would also give ChecknGo a call to advise them of the information.
THANKS
I WILL CALL FULTON SHERIFF'S DEPT. ON MONDAY. I KNOW ITS A SCAM AS I CALLED THAT RECORDED MSG. BACK AND TOLD THEM ON THE MSG. THAT I WOULD BE GATHERING UP ALL MY INFO. THIS CALL BACK WAS MADE YESTERDAY EVENING (THURS. DEC. 18TH) TODAY DEC 19TH, NO CALLS FROM THIS INVESTIGATOR PHILLIPS OR THIS MR. ROSS. I ASSUME THEY GET THE MESSAGE I AM SENDING OUT TO THEM. THANKS FOR ALL YOUR HELP!! THIS WEB SITE IS A REALLY GREAT PLACE
EXACTLY same thing happened to me
I would love to see if they are for real or not....I was under the impression that legally a post dated check is no good until they go to civil court to collect. Funny people!

I'd deffiently contact the sherif's number (the ligitimate one you found) and let them know what's going on, and give them all the information you have.
Sounds like Delanor Kemper and Associates, an Atlanta collection
Sounds like Delanor Kemper and Associates, an Atlanta collection agency that's a better candidate for a RICO indictment than a Chamber of Commerce award. They got hold of a bunch of junk debt and are calling all kinds of people claiming to be "inspectors" and threatening prosecution over payday loans. They're contact info is:
2221 PEACHTREE RD NE
ATLANTA, GA 30309
P - 404-524-0800
F - 404-524-0896
BTW - Texas law doesn't distinguish between collection agencies and original creditors the way federal law does. There are a LOT of texas lawyers that take consumer cases like the one you have on a CONTINGENCY basis. I'd sue both Check n Go AND Delanor if I was in your shoes.
I just don't understand why they won't accept payment plans. Some
I just don't understand why they won't accept payment plans. Some money is better than no money I always say.
Has this been resolved yet?
We received a call today from this number 404-705-7205,actually my husband did at work.He was told he had a warrant for check fraud. As soon as I heard the details of his conversation with the people he talked to at that number and the people at the subsequent number he was given 678-760-9846 I called b.s. and started researching online.I have even called the Fulton County Sheriff's warrant division 404-612-5125 and left a message with the warrant number and I am awaiting for a return call regarding that.My husband was told that he would be picked up by Tarrant county tomorrow at work if we did not pay by 5 pm today, and we could only pay with a debit card, and on top of that this man was able to have the debt reduced by almost 80%,I have never heard of any court allowing someone to be arrested for check fraud then allowing for the deb to be reduced by that much.I called the 678-760-9846 number myself and asked the man that answered if he was in any way affiliated with the Fulton County Sheriff's department and he hung up on me.Once I get a call back from the REAL sheriff's department I will make a note on here as to what happened.
long story short
I called the number Fulton county sheriff's office and got the real number for the warrant division it is 404-612-5125 and the person that is in charge of the warrants dept is a Miss Thelma Rolax.I asked her if she could look up my husbands name and the warrant number, she told she couldn't give that info out over the phone but she said the warrant number I gave didn't sound right!I then asked if an investigator Phillips was available she told me there was no such person and I asked if the phone # of 404-705-7205 belonged to the Fulton County Sheriff's office and she said no it wasn't.I am planning on going to my local police department on monday and having them do a search for this warrant # that Mr Ross gave me.
Also later that same day that Mr Ross first called he called back and asked to speak to my husband I told him my husband was not avaialable but I would gladly talk to him and deliver any message he had for my husband,he asked what my husband next move was going to be and I told him that we would be contacting our local police department ourself as well as Ace,the store we got the loan from to verify the "warrant".Then we would get back to him...he hung up on me!
