Client unable to provide proof

My son's credit report showed an amount of 275 as unpaid debit posted by a collection agency. Upon following up with the agency, we came to know that it was from his previous rental place. We followed up with the rental agency, they were unable to provide evidence as to why the charge was made. The rental agency agreed to advice the collection agency to resolve this as non debit. While this happens, can some one please advice as to damage claim can we make to the collection agency or the Client? It seems that this negative charge was on my son's CR for a while and he was infact paying higher interest on all - his credit cards, insurance etc.


I believe the only thing you can do is you first have to dispute it and if it comes back verified then you can sue per the FCRA.

If the file was mistakenly put there and it gets removed, then there really isn't much you can do.

I could be wrong maby someone can correct me if I am.

Yes plus as I stated above you items entered in error would not be suit worthy. Just something you have to suck it up.

You won't know that till you dispute it though, if it comes back verified, that is grounds for a lawsuit as you know it's not his.

You may need an attorney at that point as FCRA violations are $1,000 per violation, fdcpa are $1,000 total
