I'm on permanent disability. Can this company take me to court to pay for an old capital one mastercard?


They can take you to court and they can get a judgment against you. If you never plan on returning to work and don't care about your credit then let them waste their money to do this. Otherwise you can do the following.

Make them prove the debt is yours. Make them prove the statute of limitations has not passed. Fight them till the end as they most likely can't prove you own the debt.

They cannot touch your money, plain and simple. If you have assets that are not exempt, they can get those. If you have no assets then you are judgment proof!!! If they sue you and end up with a judgment it is important not to sign any agreements to pay them. also you would need to tell them any money in your bank accounts is from SSDI.. They will attempt to trick you into paying, don't fall for it, tell them you can't pay a dime. They can't force you to pay so you can pretty much laugh in their face.
