Collection agency need to be license to collect from nyc residents

I did research and found out that a collection agency must be license with the department of consumer affairs in order to collect any debt from a new york city resident.So am i to assume that if they do not have a license they can not try to collect is there anyone here no for sure about this?


you are correct.it is that way in my state of illinois.a collector must be licensed in my state and if a lawyer collecting must be bonded in my state.that does apply to NY as well.

thanks paul so what you think i should about aca recovery they are trying to collect for instant cash i already sent them letters i just check to see if they are license to collect in nyc and i did not see their name so how should i handle them iwas going to send a c and d letter and a copy of the laws here in nyc about needing a license what u think?

since pdl's are prohibited in NY.i would inform this bottomfeeder of that.if you do a search in the bar at top right.you will find out what a bunch of cretins your dealing with.who are not licensed period much less in NY.yes send C&D letters asap.send them certified mail return receipt.include a debt validation letter with the C&D letter.once they receive those they cannot contact unless by mail or attempt to collect until they can validate.seeing as though pdl's are illegal in NY i doubt they can validate.

Paul id send them a debt validitation letter certified mail.Then few days later recieved 2 of the same letters on seperate days saying they represent instant cash and to send payment.I called they said they did not have any dv on file i told them i have signature.I then faxed them the dv letter and also letter on how pdls are illegal prohibited.i just recieved yesterday in the mail a copy of the pplication i filled out on the internet for the loan they mailed me a copy of this contract.So what now?I should not have to worry about this right? i am sending them on monday c and d letter along again of how pdls are illega.

i would file AG,FTC and BBB complaints on monday.then look into your legal rights.if you did send this bottomfeeder DV and C&D letters cmrrr.you do have the green receipt with a signature right?if so they can't attempt any collections.look into a consumer attorney in your area...naca.net,that will help you locate an attorney.until then get those complaints out on monday and do not bother with this CA until then.

Hi all. Great site! (BTW, I'm a different Paul - not the moderator)

I also have 3 outstanding PDL's where the CA (in my case Certified Recovery System) is showing up on 2 of my CR's. I sent them a DV that was received on Friday and am awaiting the green card back. Am looking forward to hearing how you make out with the NYS AG as I'm in NY myself (Bronx).
