Collection Agency Phone Calls ?

Hello, Ok how can I Stop NES collection from calling my Job and Home ? Also i have already sent them a letter of debt validation. Thanks.


Ok i have not even had the phone pluged in lately because NES is unreasonable, and they dont know where i work, is there any way they can find out ?

i would send them a second certified letter telling them that they are now in violation of section 809 of the FDCPA. Inform them that they have ignored your validation request and that this is their final opportunity to avoid further action, including being sued. Tell them if you receive as much as one more collection call from them after the date they sign for this letter, that you will not hesitate to file suit for FDCPA violations. Hopefully you sent out your first DV letter to them by certified mail--if so, then feel free to photocopy both the letter you sent them and the green USPS receipt card, and send the COPIES along with this letter to show them that you can prove your case.

Also in this letter tell them that they may consider this a demand to cease all telephone contact entirely--that from now on, all communication in this matter is to be done through the mail.

if they continue calling, then take em to court. some people have to be taught the hard way...

Was your DV timely? W/in 30 days of receiving the initial dunning letter? If not, then collection efforts do not have to cease. What state do you live in? I've had many CA's ignore the no phone calls to my home so I add "Calls to my employer place my employment in jeopardy" and "All calls to my home and cell are recorded". That will work for 2 party states if the call after recieving your DV, they are consenting to be recorded. From personal experience, it's easier to nail them on concrete violations if you have recordings vs violating a "limited C&D". Remember the "least sophisticated consumer" concept. Last CA I dealt with on the phone violated w/in the first 30 seconds and I had 7 by the end of a 5 minute conversation. I've goten 3 more calls from them and it's a shame the FDCPA violations are $1000 per action. They should be receiveing their summons this week.

steps 8, 9, 10 -- BlackList or WhiteList for home phone. If you owe a debt you have an obligation. If you have been WRONGFULLY billed there is no reason to tolerate/permit any calls

Additionally: Insist all communication be in WRITING. Advise them you will no longer take their calls. If they are legitimate they will already have your mailing address.
