Help!! Few questions!

I live in Wisconsin, have 2 legal store front loans, and neither are affiliated w/the CFSA. I want to close my checking account, and open a new one. I want to pay these off, but can't w/the interest cycle. If I do this, and also, send them a letter prior, or after that they I do NOT give them the authority to deposit my checks, and to NOT contact anyone other than myself regarding my debt...and only by my personal phone....will they have to adhere to that? Are both of those legal requests they must abide by?
ALSO...one of my loans, by Check-Advance...they want me to take out another loan, added on to the current one so that I can pay my interest!!! Can you believe that crap? Is that legal? Also, they have been hounding me abut getting them a new recent bank statement, and pay stub.....if they DON'T get that information, and have rolled my loan over after a certain period of time....does that void anything out??? Like, they could possibly be still loaning me the money w/out the proper documentation initially presented 6 months ago?s

First thing to remember is that these managers get a bonus if they have a small % of defaulted loans. That is why they want you to take out another loan.
What you need to do is contact the branch manager about this 2nd loan thing. They should not offer another loan when they know darn well that you cannot pay the first one. This is what ticks me off about WI laws.( I am from WI also) You can also contact the department of financial institution and talk to them about this company.

I had check n go want me to write them another check from a closed checking account :shock: I talked to the district manager letting her know that the manager of that store wanted me to do that so she could get her bonus. Well that store manager no longer works there. What she wanted me to do was fraud and I could have gone to jail just so she could get her bonus, heck no!!!
Anyway, if you call the district manager and talk to them, tell them your situation and let them know that you have to default and ask what happens when you default. Offer some kind of payment arrangement that you can afford. They may tell you that they will send the account over to a collection agency and you can work it out with them. But they will have to cash your check first and get it back NSF. If you close your checking account or put a stop pay on your check they can and probably will take you to court and offer not other payment arrangements.
The only way they should contact your references is if they cannot contact you. So make sure that you talk to them. With the updated paperwork they wanted, they usually like to update their records every 3 months. But they may also want to check to see if you really don't have the money to pay them. And to make sure you still have your job (thats just a thought). I would just talk to someone higher up on the ladder. If you have to go all the way to the corp. office. I did that with the cash store. I called a different storefront than the one I was dealing with to get the corp. offices phone number to see what they did about NSF checks and got all the answers I need from them.

As I have stated many times, do not mess with the store personell!! Go directly to the Corp Office. If you go to the store, they will probably have a number posted for comments and complaints or just ask the manager.
As for some of your issues, they should not be asking you to take take a second loan. We can only hold one check at a time in WI.
You cannot stop them from depositing your check.

I'm from WI as well and currently working with DFI regarding Check'n'go trying to deposit my check three times in one day (clearly against WI payday laws) Check'n'go tried telling them that since I signed a contract that gives them the right to go into the account whenever they feel like basically. I kid you not. DFI told me that even if I signed a contract that doesn't trump the law. The Law overrules the contract. So they went back to Check'n go and i'm still waiting on an outcome on it.
chele007, i'd do as puddlejmpr suggested. Contact the District Managers of the storefronts. If you get no where with them, then contact DFI. They are great to work with, and will answer any questions you have.

Best route may be to stop all direct deposits to that bank account, send all creditors another Cease and Desist letter and tell them to stop debiting your account as it will be closed on (whatever date you put in there), tell them you will NOT talk to them on the phone but only via United States Postal Mail (no emails and they are not to contact anyone other then you because that violates the fdcpa). Then, let your bank know to block any debit attempts to your account from them (your bank should be able to trace what name they tried to debit your account under) and then when the date you gave to them comes, close your account and open a new one. You told them you were going to do it, be sure you sent the letter Certified Return Receipt thru USPS (don't use email) and discuss payment options with them only thru written letters.
In most states, it is illegal for ANY business to take a "post dated" check or take a check where they know they will be depositing it at a later date but states vary so much with what they are doing. Just keep up with a file on all of your corespondance, replies from them, etc and go to that link that dawnlango7 gave you. Good luck!!
