Today I got a call from H&P a collection agency telling me I had until the end of the to pay 329.00 and the loan amount was 255.00 I told I did not have the money at this time and he was so mean and told me that legal action (jail) would come against me and they would come to my job and I needed to get a attorney because I was facing check fraud.Can they come to my job or can I lose my job and could I go to jail


So I can't be arrested or lose my job due to this payday loan even though I closed my account so I couldn't accumulate any overdraft charges due to Ace trying almost everyday to get money out my account I had some many overdraft charges it was ridiculous now this H&P company who is an outside collection agency is threatening me with some legal action (jail). and threatening to come to my job! So tell me again, they can't do any of this it is a storefront payday loan center called Ace Cash Express.

hiya,

no, they cannot arrest you for that. it is a very well known tactic that they use to try to scare you into paying....it's also very highly illegal for them to do it too.

I would contact your state's attorney general's office and inform them of these calls and the threats they are making against you. The AG's offices around the country are really starting to get sick of these companies and they are turning up the heat on them.

hi all, i posted to a thread under payday loan help in regards to H & P Capital and who they are and all of their information since it seems no one could actually verify who they are. So I am pasting my reply here as well to better inform the community so all will have the info for the battles and win the war against a company that in my opinion is skirting the line.

Here is my post from the other thread.

After much searching, I have found the legitimate info on this company. I found all of this from the State of Florida website, FLORIDA DEPARTMENT OF STATE, DIVISION OF CORPORATIONS and will paste it in the body here after I explain. First, yes they are a collection agency and nothing more than that. Second, remember that they must disclose their address if requested, or they will be in violation of the fdcpa, but once I post this, it wont ever matter. What you will find interesting, is that they were just incorporated effective as of 10/14/2008. The other 2 interesting points you will find will be:#1 they are in the exact same location as Legal Mediation used as their principal address(and I mean exact ) #2, the treasurer is the same person that was the treasurer for Legal Mediation before she resigned her position before they disolved officially on 10/31/2008. She resigned her position effective 10/27/2008, her name is Tammy Mackey.

I had the same thing happen... they called my fiance at his job and told him that if he didn't pay the full amount by the following day at noon that a case would be filed against him, he would go to court have to pay all lawyer and court cost and be arrested on the spot... the guy he talked to Richard was very RUDE. So I called back this man so rude I began to cry, he told me it wasn't his fault that my fiance cant take care of his debt and that unless I wanted him in jail I better get some money together, he suggested that I call and ask my family and friends for money. I refused. I ended up sending them $75 2 days later to get him off our back but it didn't help the next he wanted to me to make another payment. He said not to cry to him this wan;t his fault that I could go and cry to my fiance... VERY unprofessional, I was shocked no one has ever spoken to me like that before. I just got finished filing a complaint with the FTC. I hope that all of you will this company is screwy and should be shut down.
