Getting calls for my friends payday loan
Date: Mon, 01/05/2009 - 19:49
I'm sending out a cease and desist letter tomorrow.
Here is my question:
She lied on her loan application. She is a single mom and has not been employed for at least a year. I'm not sure if she forged a pay stub or not but she said she was desperate and edited her bank statement to reflect her income exaggeration.
She is really upset and worried. While I don't condone what she did I feel for her as she needed the money for food, diapers, and rent.
She borrowed $1000. I'm not sure what the fees are up to. She thinks she may get arrested for what she did so I am considering helping her out of this mess (financially). They are calling her daily (as well as me and her mother)
Forging her bank documents was highly illegal and highly stupid - i know. The only way I'm helping her out of this is if it comes to the point of her going to jail. She says they have been telling her she will get arrested for committing fraud. I'm not sure if this is just their scare tactics or if they found out what she did.
What is the likely hood of them pursuing criminal charges? My understanding was online payday loans have been outlawed? She lives in NJ but she says the loan agreement states "Governed by the laws of Delaware"
I'm not sure what the website is but as soon as I find out I will post it.
Any advice would be appreciated.

I have found out that in New Jersey internet payday loans are illegal. So, I think they can't do anything to your friend. Please check the the following url: -

If she forged documents then she may be up for criminal charges.
If she forged documents then she may be up for criminal charges. Had she paid anything towards the loans?
Since payday loans are illegal in NJ they may not try criminal action since what they was illegal as well. They will hound her though for the money and may turn it over to a collection agency and have them file a civil case against her.
Oh yeah. She has not payed anything toward the loans.

if they are going to be mean they could send a copy of the forge
if they are going to be mean they could send a copy of the forged stuff to her bank and her bank might try something though i seriously doubt that.
desperation is no excuse to commit fraud which with an illegal company or not she has committed. id distance her from myself if i were you. she had no problem doing this to herself. what next? saying you are her employer? or something else? something worse?
