Question regarding Credit Bureau dispute
Date: Tue, 01/06/2009 - 11:51
I have a collection item from HSBC which was sold off to LVNV (collection agency).
On my credit report, it showed that the LVNV item is supposed to stay on my credit until 1/09. I tried disputing the item with Experian to show the HSBC and LVNV items were too old to be on my report...it hasn't given me the results for LVNV yet, but said that the HSBC item is verified to continue on my record. There is no indication of when the HSBC item will fall off my record according to Experian.
Did I jump the gun? Should I have waited until the end of January to dispute that this item is too old?
I called Experian but was told to review the phone number on my credit report (which there was none). The 888 number just gives you a recording. I feel frustrated and like I am running in circles...
Thanks for any help, in advance.
Erica

When you were on the phone, did you ask for the date of first default as reported by the data furnisher. The date should be the same on both LVNV and HSBC. Legally, they can report for 7 years + 180 days from the DOFD. Call all 3 CRA's and make sure that the dates match.

When I was on the phone the first time, it was just a recording. I couldn't even get through to anyone...but I was finally able to get a live person at Experian after checking the web for a phone number - 800-493-1058. The representative is removing the LVNV item for me, but said that the HSBC one is showing no date of removal.
It's hard to tell when my first Date of Default with HSBC was, because there are a few 'paid on time' dates in between. Technically, it should have been 1/02 when my default started... but on the Experian report, it reads like this:
Jan 02 - OK
Feb 02 - 30
Mar 02 - 60
April 02 - OK
May 02 - OK
Jun 02 - 30
Jul 02 - 60
Aug 02 - 90
And from there it goes into default.
According to those numbers, the date of first default will be Ju
According to those numbers, the date of first default will be June, 2002. it is not when you first become past due--it is when the current delinquency first started. if you get behind, and then you pay the account up current like it shows you did in April 2002, then that delinquency is not the one youre looking for. As long as you never paid the account current after May 2002, then that is the date of first default, according to what you just posted. That means that it can legally stay on your report until December, 2009, as long as those numbers are correct.

That's the part that is not making sense... the credit report is showing a later default date than what is accurate.
HSBC was the original creditor and LVNV was the collection company. LVNV showed the correct start/end date for the collection... but HSBC is showing a later one. It just doesn't make sense.

The dates should be identical. like sky posted, 06/02 is your DOFD based on what you posted which would put the removal date at 12/10 or 01/11 depending on whether they report to the bitter end. 7 years + 180 days

I know its 7 years for the credit report. In terms of statute of limitations (sol) for a civil case: does that also start at DOFD or at another time. (Reference an auto loan / repo).
